(1) From the appropriations under s. 20.143 (1) (d) and (Lm), the
10department may award financial assistance as provided in sub. (2) (a) to a business
11if all of the following apply:
AB133-ASA1-AA15,2,1312 (a) The business is located in this state and satisfies any of the following
13criteria:
AB133-ASA1-AA15,2,1414 1. The business has no more than 35 full-time employes.
AB133-ASA1-AA15,2,1615 2. The business had no more than $2,500,000 in gross annual income in the
16year preceding the year in which the business receives the financial assistance.
AB133-ASA1-AA15,2,1917 (b) The business uses the financial assistance to provide skills training or other
18education related to the needs of the business to current or prospective employes of
19the business.
AB133-ASA1-AA15,2,2120 (c) The business submits a plan to the department detailing the proposed use
21of the financial assistance and the secretary approves the plan.
AB133-ASA1-AA15,2,2422 (d) The business enters into a written agreement with the department that
23specifies the conditions for the use of the financial assistance, including reporting,
24auditing and repayment requirements.

1(e) The business agrees in writing that, before providing training or other
2education to a current or prospective employe with the financial assistance, it will
3enter into a contract with the employe under which the business agrees to retain the
4employe, and the employe agrees to work for the business, for at least one year after
5the employe's training or education is completed.
AB133-ASA1-AA15,3,76 (f) The business agrees in writing to submit to the department the report
7required under sub. (3) by the time required under sub. (3).
AB133-ASA1-AA15,3,10 8(2) (a) The department may not award a business more than $10,000 in
9financial assistance under this section. One-half of the amount awarded to a
10business shall be a grant and one-half shall be a loan.
AB133-ASA1-AA15,3,1411 (b) In awarding financial assistance under this section, the department shall
12give preference to businesses in industries with especially severe labor shortages.
13The department shall consult with the department of workforce development to
14determine which industries are experiencing severe labor shortages.
AB133-ASA1-AA15,3,17 15(3) A business that receives financial assistance under this section shall submit
16to the department, within 6 months after spending the full amount of the proceeds,
17a report detailing how the proceeds were used.".
