TO 1999 ASSEMBLY BILL 175

AB175-ASA1,1,3 1An Act to amend 30.62 (3) (a); and to create 30.62 (3) (c) of the statutes;
2relating to: requiring that personal flotation devices be worn by certain
3underaged persons in certain boats.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB175-ASA1, s. 1 4Section 1. 30.62 (3) (a) of the statutes is amended to read:
AB175-ASA1,1,85 30.62 (3) (a) Every boat, except a sailboard and except as provided in par. (b)
6pars. (b) and (c), shall carry at least one personal flotation device prescribed by
7federal regulations for each person on board or being attended by the boat, so placed
8as to be readily accessible and available to the persons.
AB175-ASA1, s. 2 9Section 2. 30.62 (3) (c) of the statutes is created to read:
AB175-ASA1,2,310 30.62 (3) (c) No person may operate a boat that is less than 26 feet in length,
11that is being driven by a motor of more than 25 horsepower and that is under way
12unless each person on the boat who is 12 years of age or under is wearing a personal

1flotation device or is in a cabin space or below the deck. The personal flotation device
2shall be a type I, type II, type III or type V personal flotation device as specified under
333 CFR part 175, subpart B.
