ASSEMBLY AMENDMENT 7, TO 1999 ASSEMBLY BILL 324

AB324-AA7,1,1 At the locations indicated, amend the bill as follows:

AB324-AA7,1,3 1. Page 5, line 20: delete "A physician" and substitute " Subject to sub. (5), a physician".

AB324-AA7,1,5 2. Page 7, line 4: delete " A hospital" and substitute "Subject to sub. (5), a hospital".

AB324-AA7,1,6 3. Page 8, line 10: after that line insert:

AB324-AA7,1,7 " Section 12m. 253.09 (5) of the statutes is created to read:

AB324-AA7,1,10 253.09 (5) This section does not provide immunity to a person who provides obstetric and gynecological services to a woman if the person does not do all of the following:

AB324-AA7,1,13 (a) Provide all of the tests and procedures that the standard of care required of a reasonable practitioner of obstetric and gynecological services to women would require.

AB324-AA7,2,3 (b) Provide the woman with the results of all of the tests and procedures required under par. (a) in a manner that allows the woman to make an informed decision regarding future health care procedures.".

AB324-AA7,2,5 4. Page 8, line 15: delete " A person" and substitute "Subject to par. (c), a person".

AB324-AA7,2,6 5. Page 9, line 17: after that line insert:

AB324-AA7,2,7 " Section 16m. 441.06 (6) (c) of the statutes is created to read:

AB324-AA7,2,10 441.06 (6) (c) This subsection does not provide immunity to a person who provides obstetric and gynecological services to a woman if the person does not do all of the following:

AB324-AA7,2,13 1. Provide all of the tests and procedures that the standard of care required of a reasonable practitioner of obstetric and gynecological services to women would require.

AB324-AA7,2,16 2. Provide the woman with the results of all of the tests and procedures required under subd. 1. in a manner that allows the woman to make an informed decision regarding future health care procedures.".

AB324-AA7,2,19 7. Page 11, line 15: after that line insert:

AB324-AA7,2,20 " Section 22m. 448.03 (5) (aw) of the statutes is created to read:

AB324-AA7,2,23 448.03 (5) (aw) Paragraph (ar) does not provide immunity to a person who provides obstetric and gynecological services to a woman if the person does not do all of the following:

AB324-AA7,3,3 1. Provide all of the tests and procedures that the standard of care required of a reasonable practitioner of obstetric and gynecological services to women would require.

AB324-AA7,3,6 2. Provide the woman with the results of all of the tests and procedures required under subd. 1. in a manner that allows the woman to make an informed decision regarding future health care procedures.".
