AB659-ASA1,1,3 1An Act to amend 66.94 (9m) and 85.205; to create 85.20 (4m) (g) of the statutes;
2and to affect 1999 Wisconsin Act 9, section 9150 (3bm); relating to: light rail
3and the urban mass transit operating assistance program.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB659-ASA1, s. 1 4Section 1. 66.94 (9m) of the statutes, as created by 1999 Wisconsin Act 9, is
5amended to read:
AB659-ASA1,2,76 66.94 (9m) Limit on contracting for operation or maintenance of light rail.
7Notwithstanding any other provision of this section, no authority may enter into a
8contract for any purpose related to the operation or maintenance of a light rail mass
9transit system if the cost of any of the contracted items would be paid for by, or
10reimbursed with, federal funds received under P.L. 102-240, section 1045, or P.L.
11105-277, section 373, or any funds received from the state, except as provided in s.
1285.20 (4m) (g)
. This subsection does not apply to any light rail mass transit system

1that is being constructed on October 29, 1999. This subsection does not apply to any
2funds expended or activity related to a mass transit system that is done under the
3memorandum of agreement concerning USH 12 between Middleton and Lake
4Delton, Wisconsin, that was executed by the governor, the secretary of
5transportation, the secretary of natural resources, the county executive of Dane
6County, the administrative coordinator of Sauk County, and others, and that became
7effective on April 22, 1999. This subsection does not apply after June 30, 2001.
AB659-ASA1, s. 2 8Section 2. 85.20 (4m) (g) of the statutes is created to read:
AB659-ASA1,2,259 85.20 (4m) (g) Notwithstanding sub. (3), the department may not pay state aids
10under this section for a mass transit system that provides transportation services by
11rail unless the transportation services by rail are provided on or before the effective
12date of this paragraph .... [revisor inserts date]. Any increase in the level of
13transportation service by rail of a mass transit system that provides such service on
14or before the effective date of this paragraph .... [revisor inserts date], is eligible for
15an increase in the amount of state aid payable under this section. An eligible
16applicant may not use aids paid under this section to support transportation services
17by rail unless the services are eligible for aid under this section. This paragraph does
18not apply to Amtrak, as defined in s. 85.06 (1) (a). This paragraph does not apply to
19any light rail mass transit system that is being constructed on October 29, 1999. This
20paragraph does not apply to any funds expended or activity related to a mass transit
21system that is done under the memorandum of agreement concerning USH 12
22between Middleton and Lake Delton, Wisconsin, that was executed by the governor,
23the secretary of transportation, the secretary of natural resources, the county
24executive of Dane County, the administrative coordinator of Sauk County, and
25others, and that became effective on April 22, 1999.

1Section 3. 85.205 of the statutes, as created by 1999 Wisconsin Act 9, is
2amended to read:
AB659-ASA1,3,15 385.205 Prohibited expenditures for light rail. Notwithstanding ss.
485.022, 85.062 and 85.063, the department may not encumber or expend any federal
5funds received under P.L. 102-240, section 1045, or P.L. 105-277, section 373, or
6state funds for any purpose related to operating or maintaining a light rail mass
7transit system, except as provided in s. 85.20 (4m) (g). This section does not apply
8to any light rail mass transit system that is being constructed on October 29, 1999.
9This section does not apply to any funds expended or activity related to a mass transit
10system that is done under the memorandum of agreement concerning USH 12
11between Middleton and Lake Delton, Wisconsin, that was executed by the governor,
12the secretary of transportation, the secretary of natural resources, the county
13executive of Dane County, the administrative coordinator of Sauk County, and

AB659-ASA1, s. 4 16Section 4. 1999 Wisconsin Act 9, section 9150 (3bm) is renumbered 66.941 of
17the statutes and amended to read:
AB659-ASA1,4,8 1866.941 Contracting Use of certain funds for design or construction
19operation or maintenance of light rail prohibited. Notwithstanding any other
20provision of this chapter or ch. 59, 60, 61, or 62 or 66 of the statutes, no governing
21body of any city, village, town or county, and no agency, corporation, instrumentality
22or subunit of a city, village, town or county, may enter into a contract for any purpose
23related to operating or maintaining a light rail mass transit system if the cost of any
24of the contracted items would be paid for by, or reimbursed with, federal funds
25received under P.L. 102-240, section 1045, or P.L. 105-277, section 373, or any funds

1received from the state, except as provided in s. 85.20 (4m) (g). This subsection
2section does not apply to any funds expended or activity related to a mass transit
3system that is done under the memorandum of agreement concerning USH 12

AB659-ASA1, s. 5 9Section 5. Effective dates. This act takes effect on July 1, 2001, except as
10follows:
AB659-ASA1,4,1211 (1) The treatment of section 85.20 (4m) (g) of the statutes takes effect on the
12day after publication.
