AB731-ASA1-AA16,1,3 3" Section 4n. 46.515 (4) (b) 1m. of the statutes is amended to read:
AB731-ASA1-AA16,1,104 46.515 (4) (b) 1m. No person who is required or permitted to report suspected
5or threatened abuse or neglect under s. 48.981 (2) may make or threaten to make
6such a report based on a refusal of a person to receive or to continue receiving home
7visitation program services under subd. 1. No county or Indian tribe may request
8that a petition be filed under s. 48.25 alleging that a child is in need of protection or
9services under s. 48.13 based on a refusal of a person to receive or to continue
10receiving home visitation program services under subd. 1.
AB731-ASA1-AA16, s. 4t 11Section 4t. 46.515 (6) (b) 4. of the statutes is amended to read:

146.515 (6) (b) 4. `Nonentitlement.' No individual is entitled to any payment
2from a fund established under subd. 1. or 2. Nothing in this section shall be construed
3as requiring a county or Indian tribe to make a determination described in sub. (1)
4(b) 2. A determination described in sub. (1) (b) 2. may not be construed to be a
5determination described in s. 48.981 (3) (c) 4. A determination described in sub. (1)
6(b) 2. b. that a child, the child's parents or the person primarily responsible for the
7child's care is unwilling to cooperate with an informal plan of support and services
8may not be used as the basis for filing a petition under s. 48.25 alleging that the child
9is in need of protection or services under s. 48.13. No person who is required or
10permitted to report suspected or threatened abuse or neglect under s. 48.981 (2) may
11make or threaten to make such a report based on a determination described in sub.
12(1) (b) 2. b. that a child, the child's parents or the person primarily responsible for the
13child's care is unwilling to cooperate with an informal plan of support and services.
