SB417-SSA1,1,5 1An Act to repeal 149.143 (3c); to amend 20.435 (4) (af), 20.435 (4) (af), 149.143
2(1) (a), 149.143 (1) (a), 149.143 (2m) (a) 1., 149.143 (2m) (a) 1., 149.143 (2m) (a)
32. and 149.143 (2m) (a) 2.; and to create 149.143 (3c) of the statutes; relating
4to:
maintaining premiums in fiscal years 2000-01 and 2001-02 under the
5health insurance risk-sharing plan at current rates.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB417-SSA1, s. 1 6Section 1. 20.435 (4) (af) of the statutes, as affected by 1999 Wisconsin Act 9,
7is amended to read:
SB417-SSA1,1,128 20.435 (4) (af) Health insurance risk-sharing plan; transfer to fund for costs
9and to maintain premium level. The amounts in the schedule to be paid into the
10health insurance risk-sharing plan fund to be used first for maintaining premiums
11at the level specified in s. 149.143 (3c) and then
for paying a portion of the operating
12costs of the health insurance risk-sharing plan under ch. 149.

1Section 2 . 20.435 (4) (af) of the statutes, as affected by 1999 Wisconsin Act ....
2(this act), is amended to read:

, necessary to cover 60% of the plan costs for the plan year, after
9deducting the amount transferred to the fund from the appropriation account under
10s. 20.435 (4) (af) for operating costs.

12Act .... (this act), is amended to read:
SB417-SSA1,3,1813 149.143 (2m) (a) 2. The amount of premiums, including amounts received for
14premium and deductible subsidies and the amount transferred to the fund from the
15appropriation account under s. 20.435 (4) (af) for maintaining premiums at the level
16specified in sub. (3c)
, necessary to cover 60% of the plan costs for the plan year, after
17deducting the amount transferred to the fund from the appropriation account under
18s. 20.435 (4) (af) for operating costs.
SB417-SSA1, s. 9 19Section 9. 149.143 (3c) of the statutes is created to read:
SB417-SSA1,4,320 149.143 (3c) Notwithstanding subs. (1), (2) and (3), premium rates in fiscal
21years 2000-01 and 2001-02 for eligible persons with coverage under s. 149.14 may
22not exceed the rates in effect for those eligible persons in the 1999-2000 fiscal year.
23Notwithstanding subs. (1), (2) and (3), if premiums for fiscal year 2000-01 or
242001-02 for eligible persons with coverage under s. 149.14 will be set under sub. (2)
25(a) 2. or (3) (a) at rates that exceed the rates in effect in the 1999-2000 fiscal year,

1the department shall use moneys appropriated under s. 20.435 (4) (af) to make up
2the difference between the rates in effect in fiscal year 1999-2000 and the rates that
3are set under sub. (2) (a) 2. or sub. (3) (a) for fiscal year 2000-01 or 2001-02.
SB417-SSA1, s. 10 4Section 10. 149.143 (3c) of the statutes, as created by 1999 Wisconsin Act ....
5(this act), is repealed.
SB417-SSA1, s. 11 6Section 11. Effective dates. This act takes effect on the day after publication,
7except as follows:
SB417-SSA1,4,108 (1) The treatment of sections 20.435 (4) (af) (by Section 2) and 149.143 (1) (a)
9(by Section 4) and (2m) (a) 1. (by Section 6 ) and 2. (by Section 8 ) of the statutes and
10the repeal of section 149.143 (3c) of the statutes take effect on July 1, 2002.
