SENATE SUBSTITUTE AMENDMENT 1, TO 1999 SENATE BILL 417

SB417-SSA1,1,5 An Act to repeal 149.143 (3c); to amend 20.435 (4) (af), 20.435 (4) (af), 149.143 (1) (a), 149.143 (1) (a), 149.143 (2m) (a) 1., 149.143 (2m) (a) 1., 149.143 (2m) (a) 2. and 149.143 (2m) (a) 2.; and to create 149.143 (3c) of the statutes; relating to: maintaining premiums in fiscal years 2000-01 and 2001-02 under the health insurance risk-sharing plan at current rates.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

SB417-SSA1, s. 1 Section 1. 20.435 (4) (af) of the statutes, as affected by 1999 Wisconsin Act 9, is amended to read:

SB417-SSA1,1,12 20.435 (4) (af) Health insurance risk-sharing plan; transfer to fund for costs and to maintain premium level. The amounts in the schedule to be paid into the health insurance risk-sharing plan fund to be used first for maintaining premiums at the level specified in s. 149.143 (3c) and then for paying a portion of the operating costs of the health insurance risk-sharing plan under ch. 149.

SB417-SSA1, s. 2 Section 2 . 20.435 (4) (af) of the statutes, as affected by 1999 Wisconsin Act .... (this act), is amended to read:

SB417-SSA1,2,7 20.435 (4) (af) Health insurance risk-sharing plan; transfer to fund for costs and to maintain premium level. The amounts in the schedule to be paid into the health insurance risk-sharing plan fund to be used first for maintaining premiums at the level specified in s. 149.143 (3c) and then for paying a portion of the operating costs of the health insurance risk-sharing plan under ch. 149.

SB417-SSA1, s. 3 Section 3. 149.143 (1) (a) of the statutes, as affected by 1999 Wisconsin Act 9, is amended to read:

SB417-SSA1,2,11 149.143 (1) (a) First from the moneys transferred to the fund from the appropriation account under s. 20.435 (4) (af) for operating costs.

SB417-SSA1, s. 4 Section 4 . 149.143 (1) (a) of the statutes, as affected by 1999 Wisconsin Act .... (this act), is amended to read:

SB417-SSA1,2,15 149.143 (1) (a) First from the moneys transferred to the fund from the appropriation account under s. 20.435 (4) (af) for operating costs.

SB417-SSA1, s. 5 Section 5. 149.143 (2m) (a) 1. of the statutes, as created by 1999 Wisconsin Act 9, is amended to read:

SB417-SSA1,2,21 149.143 (2m) (a) 1. The amount of premiums received in a plan year from all eligible persons, including amounts received for premium and deductible subsidies and the amount transferred to the fund from the appropriation account under s. 20.435 (4) (af) for maintaining premiums at the level specified in sub. (3c).

SB417-SSA1, s. 6 Section 6 . 149.143 (2m) (a) 1. of the statutes, as affected by 1999 Wisconsin Act .... (this act), is amended to read:

SB417-SSA1,3,2 149.143 (2m) (a) 1. The amount of premiums received in a plan year from all eligible persons, including amounts received for premium and deductible subsidies and the amount transferred to the fund from the appropriation account under s. 20.435 (4) (af) for maintaining premiums at the level specified in sub. (3c).

SB417-SSA1, s. 7 Section 7. 149.143 (2m) (a) 2. of the statutes, as created by 1999 Wisconsin Act 9, is amended to read:

SB417-SSA1,3,10 149.143 (2m) (a) 2. The amount of premiums, including amounts received for premium and deductible subsidies and the amount transferred to the fund from the appropriation account under s. 20.435 (4) (af) for maintaining premiums at the level specified in sub. (3c), necessary to cover 60% of the plan costs for the plan year, after deducting the amount transferred to the fund from the appropriation account under s. 20.435 (4) (af) for operating costs.

SB417-SSA1, s. 8 Section 8 . 149.143 (2m) (a) 2. of the statutes, as affected by 1999 Wisconsin Act .... (this act), is amended to read:

SB417-SSA1,3,18 149.143 (2m) (a) 2. The amount of premiums, including amounts received for premium and deductible subsidies and the amount transferred to the fund from the appropriation account under s. 20.435 (4) (af) for maintaining premiums at the level specified in sub. (3c), necessary to cover 60% of the plan costs for the plan year, after deducting the amount transferred to the fund from the appropriation account under s. 20.435 (4) (af) for operating costs.

SB417-SSA1, s. 9 Section 9. 149.143 (3c) of the statutes is created to read:

SB417-SSA1,4,3 149.143 (3c) Notwithstanding subs. (1), (2) and (3), premium rates in fiscal years 2000-01 and 2001-02 for eligible persons with coverage under s. 149.14 may not exceed the rates in effect for those eligible persons in the 1999-2000 fiscal year. Notwithstanding subs. (1), (2) and (3), if premiums for fiscal year 2000-01 or 2001-02 for eligible persons with coverage under s. 149.14 will be set under sub. (2) (a) 2. or (3) (a) at rates that exceed the rates in effect in the 1999-2000 fiscal year, the department shall use moneys appropriated under s. 20.435 (4) (af) to make up the difference between the rates in effect in fiscal year 1999-2000 and the rates that are set under sub. (2) (a) 2. or sub. (3) (a) for fiscal year 2000-01 or 2001-02.

SB417-SSA1, s. 10 Section 10. 149.143 (3c) of the statutes, as created by 1999 Wisconsin Act .... (this act), is repealed.

SB417-SSA1, s. 11 Section 11. Effective dates. This act takes effect on the day after publication, except as follows:

SB417-SSA1,4,10 (1) The treatment of sections 20.435 (4) (af) (by Section 2) and 149.143 (1) (a) (by Section 4) and (2m) (a) 1. (by Section 6 ) and 2. (by Section 8 ) of the statutes and the repeal of section 149.143 (3c) of the statutes take effect on July 1, 2002.
