TO 2001 ASSEMBLY BILL 252

AB252-ASA1,1,3 1An Act to amend 20.395 (2) (eq), 20.395 (2) (ev) and 20.395 (2) (ex); and to create
284.175 of the statutes; relating to: a bicycle and pedestrian bridge inspection
3and inventory program and making appropriations.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB252-ASA1, s. 1 4Section 1. 20.395 (2) (eq) of the statutes is amended to read:
AB252-ASA1,1,115 20.395 (2) (eq) Highway and local bridge improvement assistance, state funds.
6As a continuing appropriation, the amounts in the schedule for bridge development,
7construction, and rehabilitation under s. 84.18,; for the development and
8construction of bridges under ss. 84.12 and 84.17,, 84.17, and 84.175; for payments
9to local units of government for jurisdictional transfers under s. 84.16; and for the
10improvement of the state trunk highway system under 1985 Wisconsin Act 341,
11section 6 (1).
AB252-ASA1, s. 2 12Section 2. 20.395 (2) (ev) of the statutes is amended to read:

120.395 (2) (ev) Local bridge improvement assistance, local funds. All moneys
2received from any local unit of government or other source for improving bridges
3under ss. 84.12, 84.17, 84.175, and 84.18, for such purposes.
AB252-ASA1, s. 3 4Section 3. 20.395 (2) (ex) of the statutes is amended to read:
AB252-ASA1,2,75 20.395 (2) (ex) Local bridge improvement assistance, federal funds. All moneys
6received from the federal government for improving bridges under ss. 84.12, 84.17,

and 84.18, for such purposes.
AB252-ASA1, s. 4 8Section 4. 84.175 of the statutes is created to read:
AB252-ASA1,2,10 984.175 Bicycle and pedestrian bridge inspection and inventory. (1) In
10this section:
AB252-ASA1,2,1411 (a) "Bicycle bridge" means a public structure in this state under the jurisdiction
12of the department or a local highway authority that crosses a waterway, a
13topographical barrier, a highway, or a railroad, and which is designed to be used
14primarily for bicycle travel.
AB252-ASA1,2,1815 (b) "Pedestrian bridge" means a public structure in this state under the
16jurisdiction of the department or a local highway authority that crosses a waterway,
17a topographical barrier, a highway, or a railroad, and which is designed to be used
18primarily for pedestrian travel.
AB252-ASA1,2,2119 (c) "Rehabilitating" means making major repairs necessary to restore the
20structural integrity of a bicycle or pedestrian bridge or making repairs necessary to
21correct a major safety defect.
AB252-ASA1,3,7 22(2) The department shall conduct an initial inspection and inventory of all
23bicycle and pedestrian bridges under its jurisdiction and, in consultation with
24applicable local highway authorities, shall conduct an initial inspection and
25inventory of all bicycle and pedestrian bridges under the jurisdiction of local highway

1authorities. The department shall complete the initial inspection and inventory
2required under this subsection by January 1, 2003. The department shall classify
3each bicycle or pedestrian bridge according to its safety, serviceability, and necessity
4for public use and shall determine the cost of rehabilitating the bicycle or pedestrian
5bridge or of replacing the bicycle or pedestrian bridge with a comparable facility. The
6department shall adopt standards for the bicycle and pedestrian bridge inspection
7and inventory program under this subsection.
AB252-ASA1,3,15 8(3) After the initial inspection and inventory under sub. (2) is completed, all
9bicycle and pedestrian bridges shall be inspected on a continuing basis, as
10determined by the department, including any new bicycle or pedestrian bridge not
11inventoried under sub. (2). The department shall establish standards for the
12continuing inspection program. The department shall be responsible for inspecting
13the bicycle and pedestrian bridges under its jurisdiction, and local highway
14authorities shall be responsible for inspecting bicycle and pedestrian bridges under
15their jurisdictions.
