ASSEMBLY SUBSTITUTE AMENDMENT 1, TO 2001 ASSEMBLY BILL 320

AB320-ASA1,1,6 An Act to renumber 36.25 (14); to amend 20.235 (1) (b), 20.235 (1) (fe), 20.235 (1) (fg), 20.285 (4) (b) and 20.285 (4) (dd); and to create 36.25 (14) (b), 36.34 (1) (c), 39.30 (5), 39.435 (7) and 39.44 (2m) of the statutes; relating to: the tuition, Wisconsin higher education, minority undergraduate retention, minority disadvantaged graduate students, Lawton minority undergraduate grant programs and making an appropriation.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

AB320-ASA1, s. 1 Section 1. 20.235 (1) (b) of the statutes is amended to read:

AB320-ASA1,1,10 20.235 (1) (b) Tuition grants. Biennially, the amounts in the schedule A sum sufficient equal to the amount determined under s. 39.30 (5) for the purposes of s. 39.30.

AB320-ASA1, s. 2 Section 2. 20.235 (1) (fe) of the statutes is amended to read:

AB320-ASA1,2,5 20.235 (1) (fe) Wisconsin higher education grants; University of Wisconsin System students. Biennially, the amounts in the schedule A sum sufficient equal to the amount determined under s. 39.435 (7) for the Wisconsin higher education grant program under s. 39.435 for University of Wisconsin System students, except for grants awarded under s. 39.435 (2) or (5).

AB320-ASA1, s. 3 Section 3. 20.235 (1) (fg) of the statutes is amended to read:

AB320-ASA1,2,9 20.235 (1) (fg) Minority undergraduate retention grants program. Biennially, the amounts in the schedule A sum sufficient equal to the amount determined under s. 39.44 (2m) for the minority undergraduate retention grant program under s. 39.44.

AB320-ASA1, s. 4 Section 4. 20.285 (4) (b) of the statutes is amended to read:

AB320-ASA1,2,13 20.285 (4) (b) Graduate student financial aid. The amounts in the schedule A sum sufficient equal to the amount determined under s. 36.25 (14) (a) for grants to minority and disadvantaged graduate students under s. 36.25 (14).

AB320-ASA1, s. 5 Section 5. 20.285 (4) (dd) of the statutes is amended to read:

AB320-ASA1,2,17 20.285 (4) (dd) Lawton minority undergraduate grants program. The amounts in the schedule A sum sufficient equal to the amount determined under s. 36.34 (1) (c) for the Lawton minority undergraduate grant program under s. 36.34 (1).

AB320-ASA1, s. 6 Section 6. 36.25 (14) of the statutes is renumbered 36.75 (14) (a).

AB320-ASA1, s. 7 Section 7. 36.25 (14) (b) of the statutes is created to read:

AB320-ASA1,2,20 36.25 (14) (b) 1. In this paragraph:

AB320-ASA1,2,23 a. For purposes of determining the appropriation under s. 20.285 (4) (b) for fiscal year 2002-03, "base amount" means the amount shown in the schedule under s. 20.005 for that appropriation for fiscal year 2001-02.

AB320-ASA1,3,3 b. For purposes of determining the appropriation under s. 20.285 (4) (b) for each fiscal year after fiscal year 2002-03, "base amount" means the appropriation determined under subd. 2. for the previous fiscal year.

AB320-ASA1,3,5 2. Annually, by February 1, the board shall determine the appropriation under s. 20.285 (4) (b) for the next fiscal year as follows:

AB320-ASA1,3,9 a. The board shall determine the percentage by which the undergraduate academic fees charged for the current academic year at each institution within the University of Wisconsin System has increased or decreased from the undergraduate academic fees charged for the previous academic year.

AB320-ASA1,3,15 b. The appropriation for the next fiscal year shall be the result obtained by increasing, to the nearest $100, the base amount by the highest percentage increase determined under subd. 2. a., except that, if the undergraduate academic fees for the current academic year decreased or did not change from the undergraduate academic fees charged for the previous academic year at each institution specified in subd. 2. a., the appropriation shall be the base amount.

AB320-ASA1, s. 8 Section 8. 36.34 (1) (c) of the statutes is created to read:

AB320-ASA1,3,17 36.34 (1) (c) 1. In this paragraph:

AB320-ASA1,3,20 a. For purposes of determining the appropriation under s. 20.285 (4) (dd) for fiscal year 2002-03, "base amount" means the amount shown in the schedule under s. 20.005 for that appropriation for fiscal year 2001-02.

AB320-ASA1,3,23 b. For purposes of determining the appropriation under s. 20.285 (4) (dd) for each fiscal year after fiscal year 2002-03, "base amount" means the appropriation determined under subd. 2. for the previous fiscal year.

AB320-ASA1,3,25 2. Annually, by February 1, the board shall determine the appropriation under s. 20.285 (4) (dd) for the next fiscal year as follows:

AB320-ASA1,4,4 a. The board shall determine the percentage by which the undergraduate academic fees charged for the current academic year at each institution within the University of Wisconsin System has increased or decreased from the undergraduate academic fees charged for the previous academic year.

AB320-ASA1,4,10 b. The appropriation for the next fiscal year shall be the result obtained by increasing, to the nearest $100, the base amount by the highest percentage increase determined under subd. 2. a., except that, if the undergraduate academic fees for the current academic year decreased or did not change from the undergraduate academic fees charged for the previous academic year at each institution specified in subd. 2. a., the appropriation shall be the base amount.

AB320-ASA1, s. 9 Section 9. 39.30 (5) of the statutes is created to read:

AB320-ASA1,4,12 39.30 (5) Appropriation. (a) In this subsection:

AB320-ASA1,4,15 1. For purposes of determining the appropriation under s. 20.235 (1) (b) for fiscal year 2002-03, "base amount" means the amount shown in the schedule under s. 20.005 for that appropriation for fiscal year 2001-02.

AB320-ASA1,4,18 2. For purposes of determining the appropriation under s. 20.235 (1) (b) for each fiscal year after fiscal year 2002-03, "base amount" means the appropriation determined under par. (b) for the previous fiscal year.

AB320-ASA1,4,20 (b) Annually, by February 1, the board shall determine the appropriation under s. 20.235 (1) (b) for the next fiscal year as follows:

AB320-ASA1,4,24 1. The board shall determine the percentage by which the undergraduate academic fees charged for the current academic year at each institution within the University of Wisconsin System has increased or decreased from the undergraduate academic fees charged for the previous academic year.

AB320-ASA1,5,6 2. The appropriation for the next fiscal year shall be the result obtained by increasing, to the nearest $100, the base amount by the highest percentage increase determined under subd. 1., except that, if the undergraduate academic fees for the current academic year decreased or did not change from the undergraduate academic fees charged for the previous academic year at each institution specified in subd. 1., the appropriation shall be the base amount.

AB320-ASA1, s. 10 Section 10. 39.435 (7) of the statutes is created to read:

AB320-ASA1,5,8 39.435 (7) (a) In this subsection:

AB320-ASA1,5,11 1. For purposes of determining the appropriation under s. 20.235 (1) (fe) for fiscal year 2002-03, "base amount" means the amount shown in the schedule under s. 20.005 for that appropriation for fiscal year 2001-02.

AB320-ASA1,5,14 2. For purposes of determining the appropriation under s. 20.235 (1) (fe) for each fiscal year after fiscal year 2002-03, "base amount" means the maximum appropriation amount determined under par. (b) for the previous fiscal year.

AB320-ASA1,5,16 (b) Annually, by February 1, the board shall determine the appropriation under s. 20.235 (1) (fe) for the next fiscal year as follows:

AB320-ASA1,5,20 1. The board shall determine the percentage by which the undergraduate academic fees charged for the current academic year at each institution within the University of Wisconsin System has increased or decreased from the undergraduate academic fees charged for the previous academic year.

AB320-ASA1,6,2 2. AB320-ASA1,6,4 39.44 (2m) (a) In this subsection:

AB320-ASA1,6,7 1. For purposes of determining the appropriation under s. 20.235 (1) (fg) for fiscal year 2002-03, "base amount" means the amount shown in the schedule under s. 20.005 for that appropriation for fiscal year 2001-02.

AB320-ASA1,6,10 2. For purposes of determining the appropriation under s. 20.235 (1) (fg) for each fiscal year after fiscal year 2002-03, "base amount" means the maximum appropriation amount determined under par. (b) for the previous fiscal year.

AB320-ASA1,6,12 (b) Annually, by February 1, the board shall determine the appropriation under s. 20.235 (1) (fg) for the next fiscal year as follows:

AB320-ASA1,6,16 1. The board shall determine the percentage by which the undergraduate academic fees charged for the current academic year at each institution within the University of Wisconsin System has increased or decreased from the undergraduate academic fees charged for the previous academic year.
