TO 2001 ASSEMBLY BILL 365

AB365-SSA1,1,4 1An Act to amend 287.31 (3) (b), 287.31 (3) (c) (intro.) and 287.31 (4) (a); and to
2create
287.31 (4) (e) of the statutes; relating to: the newspaper recycling fee,
3the recycled content of newsprint used in newspapers, and granting
4rule-making authority.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB365-SSA1, s. 1 5Section 1. 287.31 (3) (b) of the statutes is amended to read:
AB365-SSA1,1,76 287.31 (3) (b) The recycling status is the target recycled content specified in
7par. (c) or under sub. (4) (e) minus the actual recycled content specified in par. (d).
AB365-SSA1, s. 2 8Section 2. 287.31 (3) (c) (intro.) of the statutes is amended to read:

10recycled content is the following recycled content in the specified year:

1287.31 (4) (a) The newspaper recycling fee imposed under sub. (2) does not
2apply to the publisher of a newspaper that meets or exceeds the target recycled
3content under par. (e) or specified in sub. (3) (c).
AB365-SSA1, s. 4 4Section 4. 287.31 (4) (e) of the statutes is created to read:
AB365-SSA1,2,165 287.31 (4) (e) 1. The department may promulgate a rule under which the
6department may reduce the target recycled content under sub. (3) (c) 3. or 4. for a year
7to a percentage specified by the department in the rule that is not less than 33% for
8the publisher of a newspaper if the department determines that it is not economically
9feasible for the publisher to meet the target recycled content under sub. (3) (c) 3. or
104. for that year. To qualify for a reduction of the target recycled content, the publisher
11of a newspaper shall demonstrate that the publisher qualifies for the reduction, shall
12implement an environmental management system that the department determines
13is appropriate to the business and equivalent to an environmental management
14system that complies with the standards for environmental management systems
15issued by the International Organization for Standardization, and shall implement
16newsprint recycling or reuse activities that are acceptable to the department.
AB365-SSA1,2,2117 2. If the department promulgates a rule under subd. 1., the department may
18increase the target recycled content specified in the rule for a subsequent year to a
19percentage that is not greater than 40% if the department determines that it is
20economically feasible for publishers of newspapers to meet the increased target
21recycled content.
