SENATE AMENDMENT 1, TO 2001 ASSEMBLY BILL 464

AB464-SA1,1,1 At the locations indicated, amend the bill as follows:

AB464-SA1,1,3 1. Page 1, line 5: delete the material inserted by assembly amendment 1 and substitute "prohibitions related to certain controlled substances".

AB464-SA1,1,4 2. Page 2, line 1: before that line insert:

AB464-SA1,1,5 " Section 1g. 961.14 (5) (ac) of the statutes is created to read:

AB464-SA1,1,7 961.14 (5) (ac) 1,4-Butanediol, commonly known as "1,4-BD," if it is intended for ingestion by humans.

AB464-SA1, s. 1m Section 1m. 961.14 (5) (ag) of the statutes is amended to read:

AB464-SA1,1,12 961.14 (5) (ag) Gamma-hydroxybutyric acid (commonly known as gamma hydroxybutyrate or "GHB") and gamma-butyrolactone except any drug product containing gamma-hydroxybutyric acid that is approved by the U.S. department of health and human services under 21 USC 355 or 356.

AB464-SA1, s. 1r Section 1r. 961.14 (5) (aj) of the statutes is created to read:

AB464-SA1,2,1 961.14 (5) (aj) Gamma-butyrolactone if it is intended for ingestion by humans.

AB464-SA1, s. 1v Section 1v. 961.18 (3) (bm) of the statutes is created to read:

AB464-SA1,2,5 961.18 (3) (bm) Any drug product containing gamma-hydroxybutyric acid that is approved by the U.S. department of health and human services under 21 USC 355 or 356.

AB464-SA1, s. 1x Section 1x. 961.41 (1) (hm) (intro.) of the statutes, as created by 2001 Wisconsin Act 16, is amended to read:

AB464-SA1,2,15 961.41 (1) (hm) (intro.) Gamma-hydroxybutyric acid, gamma-butyrolactone, 1,4-Butanediol, 3,4-methylenedioxymethamphetamine, 4-bromo-2,5-dimethoxy-beta-phenylethylamine, 4-methylthioamphetamine, ketamine, or a controlled substance analog of gamma-hydroxybutyric acid, gamma-butyrolactone, 3,4-methylenedioxymethamphetamine, 4-bromo-2,5-dimethoxy-beta-phenylethylamine, or 4-methylthioamphetamine is subject to the following penalties if the amount manufactured, distributed, or delivered is:

AB464-SA1, s. 1y Section 1y. 961.41 (1m) (hm) (intro.) of the statutes, as created by 2001 Wisconsin Act 16, is amended to read:

AB464-SA1,2,25 961.41 (1m) (hm) (intro.) Gamma-hydroxybutyric acid, gamma-butyrolactone, 1,4-Butanediol, 3,4-methylenedioxymethamphetamine 4-bromo-2,5-dimethoxy-beta-phenylethylamine, 4-methylthioamphetamine, ketamine, or a controlled substance analog of gamma-hydroxybutyric acid, gamma-butyrolactone, 3,4-methylenedioxymethamphetamine 4-bromo-2,5-dimethoxy-beta-phenylethylamine, or 4-methylthioamphetamine is subject to the following penalties if the amount possessed, with intent to manufacture, distribute, or deliver is:".

AB464-SA1,3,2 3. Page 7, line 25: after page 1, line 10, of the material inserted by assembly amendment 2, insert:

AB464-SA1,3,3 " Section 12m. 961.41 (3g) (f) of the statutes is amended to read:

AB464-SA1,3,7 961.41 (3g) (f) If a person possesses or attempts to possess gamma-hydroxybutyric acid, gamma-butyrolactone, 1,4-Butanediol, ketamine or flunitrazepam, the person may be fined not more than $5,000 or imprisoned for not more than 2 years or both.".
