ASSEMBLY AMENDMENT 1, TO 2001 ASSEMBLY BILL 63

AB63-AA1,1,1 At the locations indicated, amend the bill as follows:

AB63-AA1,1,3 1. Page 2, line 3: delete "The" and substitute "The Except as provided in sub. (1m), the".

AB63-AA1,1,5 2. Page 2, line 4: delete " or who knew or should have known that his or her actions caused".

AB63-AA1,1,6 3. Page 2, line 19: after that line insert:

AB63-AA1,1,7 " Section 3g. 346.67 (1m) of the statutes is created to read:

AB63-AA1,1,12 346.67 (1m) The duties imposed under sub. (1) also apply to an operator of a vehicle that has not collided with another person or vehicle whenever facts and circumstances provide notice to the operator that his or her operation of the vehicle proximately resulted in an accident resulting in injury to or death of any person or in damage to a vehicle that is driven or attended by any person.

AB63-AA1, s. 3j Section 3j. 346.67 (2) of the statutes is amended to read:

AB63-AA1,2,2 346.67 (2) Any stop required under sub. (1) or (1m) shall be made without obstructing traffic more than is necessary.

AB63-AA1, s. 3r Section 3r. 346.74 (6) of the statutes is created to read:

AB63-AA1,2,4 346.74 (6) Any person violating s. 346.67 (1m):

AB63-AA1,2,6 (a) Shall be fined not less than $150 nor more than $500 or imprisoned for not more than 3 months or both if the accident did not involve death or injury to a person.

AB63-AA1,2,9 (b) Shall be fined not less than $300 nor more than $2,500 or imprisoned for not more than one year or both if the accident involved injury to a person but the person did not suffer great bodily harm.

AB63-AA1,2,12 (c) May be fined not more than $10,000 or imprisoned for not more than one year or both if the accident involved injury to a person and the person suffered great bodily harm or if the accident involved death to a person.".
