SENATE AMENDMENT 1, TO 2001 SENATE BILL 237

SB237-SA1,1,1 At the locations indicated, amend the bill as follows:

SB237-SA1,1,2 1. Page 2, line 11: after that line insert:

SB237-SA1,1,3 " Section 2m. 146.82 (2) (a) 3. of the statutes is amended to read:

SB237-SA1,1,7 146.82 (2) (a) 3. To the extent that the records are needed for billing, collection or payment of claims. No recipient of a patient health care record under this subdivision may use the information in the record to market a health care service or product to a patient or health care provider.".

SB237-SA1,1,9 2. Page 2, line 17: delete " patient's health care provider" and substitute "practitioner, as defined in s. 450.01 (17), who prescribed a drug".

SB237-SA1,1,10 3. Page 3, line 2: after that line insert:

SB237-SA1,1,11 " Section 4m. 146.84 (5) of the statutes is created to read:

SB237-SA1,2,3 146.84 (5) Enforcement. The department of justice or a district attorney may bring an action in the name of the state to enforce sub. (2) or to restrain by temporary or permanent injunction a violation of sub. (2).".
