SENATE SUBSTITUTE AMENDMENT 1,
TO 2001 SENATE BILL 256

SB256-SSA1,1,2 1An Act relating to: national guard tuition grants, requiring the lapse of certain
2program revenue moneys to the general fund, and making an appropriation.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB256-SSA1, s. 1 3Section 1. Nonstatutory provisions.
SB256-SSA1,1,44 (1) Vacant positions in the executive branch of state government.
SB256-SSA1,1,55 (a) In this subsection:
SB256-SSA1,1,6 61. "Secretary" means the secretary of administration.
SB256-SSA1,1,9 72. "State agency" means any office, department, or independent agency in the
8executive branch of government, other than the board of regents of the University
9of Wisconsin System.
SB256-SSA1,2,710 (b) No later than 30 days after the effective date of this paragraph, the secretary
11shall determine for each state agency the number of FTE positions that are funded

1from program revenue and that have been vacant since the 1st day of the 9th month
2immediately preceding the effective date of this paragraph, other than any position
3authorized to perform duties in a state institution or facility that has not been
4completed or has not begun operations as of July 1, 2001. The secretary shall also
5determine the annual salary and fringe benefits costs for such positions and shall
6identify the program revenue appropriations from which these costs are paid during
7the 2001-02 fiscal year.
SB256-SSA1,2,118 (c) 1. During the 2001-02 fiscal year, the secretary shall lapse to the general
9fund from program revenue appropriations identified in paragraph (b) an amount
10equivalent to $532,100. The secretary shall determine from which appropriations
11the amount shall be lapsed.
SB256-SSA1,2,16 122. Each sum certain appropriation for the 2001-02 fiscal year from which an
13amount is lapsed under subdivision 1. is decreased by the amount of any lapse. Each
14continuing appropriation for the 2001-02 fiscal year from which an amount is lapsed
15under subdivision 1. is reestimated to subtract from such estimate the amount of any
16lapse.
SB256-SSA1,2,1817 (d) The secretary shall notify the joint committee on finance of all actions taken
18under paragraphs (b) and (c).
SB256-SSA1,2,2019 (2) Lapses from certain appropriations from which membership dues in state
20and national organizations are paid.
SB256-SSA1,2,2121 (a) In this subsection:
SB256-SSA1,2,22 221. "Secretary" means the secretary of administration.
SB256-SSA1,2,23 232. "State agency" has the meaning given in section 20.001 (1) of the statutes.

1(b) The secretary shall determine for each state agency the amount expended
2by the state agency for membership dues for any state or national organization in the
32000-01 fiscal year that was funded from program revenue.
SB256-SSA1,3,84 (c) The secretary shall, during the 2001-02 fiscal year, lapse to the general fund
5an amount equal to 20% of the total amount expended for membership dues for any
6state or national organization from the appropriations identified in paragraph (b).
7The secretary shall, during the 2002-03 fiscal year, lapse to the general fund from
8such program revenue appropriations an equivalent amount.
SB256-SSA1,3,139 (d) 1. Each sum certain appropriation for the 2001-02 fiscal year from which
10an amount is lapsed under paragraph (c) in that year is decreased by the amount of
11any lapse. Each continuing appropriation for the 2001-02 fiscal year from which an
12amount is lapsed under paragraph (c) in that year is reestimated to subtract from
13such estimate the amount of any lapse.
SB256-SSA1,3,18 142. Each sum certain appropriation for the 2002-03 fiscal year from which an
15amount is lapsed under paragraph (c) in that year is decreased by the amount of any
16lapse. Each continuing appropriation for the 2002-03 fiscal year from which an
17amount is lapsed under paragraph (c) in that year is reestimated to subtract from
18such estimate the amount of any lapse.

SB256-SSA1,3,2420 (1) National guard tuition grants. In the schedule under section 20.005 (3)
21of the statutes for the appropriation to the department of military affairs under
22section 20.465 (2) (a) of the statutes, as affected by the acts of 2001, the dollar amount
23is increased by $1,534,300 for fiscal year 2001-02 for the purpose for which the
24appropriation is made.
