SENATE AMENDMENT 1, TO 2001 SENATE BILL 5

SB5-SA1,1,1 At the locations indicated, amend the bill as follows:

SB5-SA1,1,3 1. Page 1, line 6: after "teams" insert ", providing an exemption from emergency rule procedures,".

SB5-SA1,1,4 2. Page 7, line 23: after that line insert:

SB5-SA1,1,5 " Section 20m. Nonstatutory provisions.

SB5-SA1,2,2 (1) The division of emergency management may promulgate emergency rules under section 227.24 of the statutes implementing section 166.20 (2) (bs) 2. of the statutes, as created by this act. Notwithstanding section 227.24 (1) (a), (2) (b), and (3) of the statutes, the division of emergency management is not required to provide evidence that promulgating a rule under section 166.20 (2) (bs) 2. of the statutes, as created by this act, as an emergency rule is necessary for the preservation of the public peace, health, safety, or welfare and is not required to provide a finding of emergency for a rule promulgated under this subsection.".
