SB55-ASA1-AA30,1,11 At the locations indicated, amend the substitute amendment as follows:
SB55-ASA1-AA30,1,2 21. Page 1129, line 6: after that line insert:
SB55-ASA1-AA30,1,3 3" Section 3445c. 346.895 of the statutes is created to read:
SB55-ASA1-AA30,1,6 4346.895 Use of cellular telephone. No person may operate a motor vehicle,
5other than an authorized emergency vehicle, while using a cellular or other mobile
6telephone unless one of the following applies:
SB55-ASA1-AA30,1,8 7(1) The operator of a motor vehicle may use a cellular or other mobile telephone
8to report an emergency.
SB55-ASA1-AA30,2,2 9(2) The operator of a motor vehicle equipped with a cellular or other mobile
10telephone device that allows the operator to talk and listen without holding the
11telephone or its handset or receiver may utilize this device if the operator does not
12hold or touch the telephone or its handset or receiver while operating the motor

1vehicle except to enable the device, enter a telephone number, or hang up or turn off
2the telephone.
SB55-ASA1-AA30, s. 3445d 3Section 3445d. 346.95 (2) of the statutes is amended to read:
SB55-ASA1-AA30,2,54 346.95 (2) Any person violating s. 346.89 (1), 346.895, or 346.94 (2), (4), or (7)
5may be required to forfeit not less than $20 nor more than $400.".
SB55-ASA1-AA30,2,6 62. Page 1425, line 21: after that line insert:
SB55-ASA1-AA30,2,9 7"(8e) Use of cellular telephones. The treatment of sections 346.895 and
8346.95 (2) of the statutes takes effect on the first day of the 4th month beginning after
9publication.".
