TO 2001 SENATE BILL 81

SB81-SSA1-SA1,1,11 At the locations indicated, amend the substitute amendment as follows:
SB81-SSA1-SA1,1,3 21. Page 1, line 2: delete "a loan from the general fund" and substitute "an
3insurer assessment".
SB81-SSA1-SA1,1,5 42. Page 1, line 6: delete the material beginning with that line and ending with
5page 2, line 8, and substitute:
SB81-SSA1-SA1,1,6 6" Section 1c. 20.515 (2) (h) of the statutes is created to read:
SB81-SSA1-SA1,1,97 20.515 (2) (h) Operating costs; insurer assessments. All moneys received from
8insurer assessments under s. 40.98 (8) for the operating costs relating to the private
9employer health care coverage program under subch. X of ch. 40.
SB81-SSA1-SA1, s. 2c 10Section 2c. 40.98 (8) of the statutes is created to read:

SB81-SSA1-SA1,1,1212 1. "Health care coverage revenue" has the meaning given in s. 149.10 (3m).

12. "Insurer" has the meaning given in s. 149.10 (5).
SB81-SSA1-SA1,2,22 3. "Resident" has the meaning given in s. 149.10 (9).
SB81-SSA1-SA1,2,33 4. "State" has the meaning given in s. 149.10 (11).
SB81-SSA1-SA1,2,84 (b) For the cost of administering the program under this section, the
5commissioner of insurance shall assess all insurers in a total amount of $850,000,
6except that the commissioner may exempt as a class those insurers whose share of
7the assessment would be so minimal as not to exceed the estimated cost of levying
8the assessment.
SB81-SSA1-SA1,2,139 (c) Each insurer shall be assessed in proportion to the ratio of the insurer's total
10health care coverage revenue for residents of this state during 2001 to the aggregate
11health care coverage revenue of all insurers subject to the assessment for residents
12of this state during 2001, as determined by the commissioner on the basis of annual
13statements and other reports filed by insurers with the commissioner.
SB81-SSA1-SA1,2,1614 (d) The commissioner shall require that the assessment be paid no later than
15July 31, 2002. The commissioner shall credit all amounts received under this
16subsection to the appropriation account under s. 20.515 (2) (h).
SB81-SSA1-SA1, s. 2m 17Section 2m. 601.41 (1) of the statutes, as affected by 2001 Wisconsin Act 16,
18is amended to read:
SB81-SSA1-SA1,2,2219 601.41 (1) Duties. The commissioner shall administer and enforce chs. 600 to
20655 and ss. 40.98 (8), 59.52 (11) (c), 66.0137 (4) and (4m), 120.13 (2) (b) to (g), 149.13,
21and 149.144 and shall act as promptly as possible under the circumstances on all
22matters placed before the commissioner.".
