SENATE AMENDMENT 1, TO SENATE SUBSTITUTE AMENDMENT 1, TO 2001 SENATE BILL 81

SB81-SSA1-SA1,1,1 At the locations indicated, amend the substitute amendment as follows:

SB81-SSA1-SA1,1,3 1. Page 1, line 2: delete "a loan from the general fund" and substitute "an insurer assessment".

SB81-SSA1-SA1,1,5 2. Page 1, line 6: delete the material beginning with that line and ending with page 2, line 8, and substitute:

SB81-SSA1-SA1,1,6 " Section 1c. 20.515 (2) (h) of the statutes is created to read:

SB81-SSA1-SA1,1,9 20.515 (2) (h) Operating costs; insurer assessments. All moneys received from insurer assessments under s. 40.98 (8) for the operating costs relating to the private employer health care coverage program under subch. X of ch. 40.

SB81-SSA1-SA1, s. 2c Section 2c. 40.98 (8) of the statutes is created to read:

SB81-SSA1-SA1,1,11 40.98 (8) (a) In this subsection:

SB81-SSA1-SA1,1,12 1. "Health care coverage revenue" has the meaning given in s. 149.10 (3m).

SB81-SSA1-SA1,2,1 2. "Insurer" has the meaning given in s. 149.10 (5).

SB81-SSA1-SA1,2,2 3. "Resident" has the meaning given in s. 149.10 (9).

SB81-SSA1-SA1,2,3 4. "State" has the meaning given in s. 149.10 (11).

SB81-SSA1-SA1,2,8 (b) For the cost of administering the program under this section, the commissioner of insurance shall assess all insurers in a total amount of $850,000, except that the commissioner may exempt as a class those insurers whose share of the assessment would be so minimal as not to exceed the estimated cost of levying the assessment.

SB81-SSA1-SA1,2,13 (c) Each insurer shall be assessed in proportion to the ratio of the insurer's total health care coverage revenue for residents of this state during 2001 to the aggregate health care coverage revenue of all insurers subject to the assessment for residents of this state during 2001, as determined by the commissioner on the basis of annual statements and other reports filed by insurers with the commissioner.

SB81-SSA1-SA1,2,16 (d) The commissioner shall require that the assessment be paid no later than July 31, 2002. The commissioner shall credit all amounts received under this subsection to the appropriation account under s. 20.515 (2) (h).

SB81-SSA1-SA1, s. 2m Section 2m. 601.41 (1) of the statutes, as affected by 2001 Wisconsin Act 16, is amended to read:

SB81-SSA1-SA1,2,22 601.41 (1) Duties. The commissioner shall administer and enforce chs. 600 to 655 and ss. 40.98 (8), 59.52 (11) (c), 66.0137 (4) and (4m), 120.13 (2) (b) to (g), 149.13, and 149.144 and shall act as promptly as possible under the circumstances on all matters placed before the commissioner.".
