AB174-ASA1,1,4 1An Act to create 23.33 (1) (g) and 23.33 (3m) of the statutes; relating to:
2operation of all-terrain vehicles on real property under the management,
3supervision, or control of the Department of Natural Resources for purposes of
4hunting deer, elk, or bear.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB174-ASA1, s. 1 5Section 1. 23.33 (1) (g) of the statutes is created to read:
AB174-ASA1,1,76 23.33 (1) (g) "Department property" means real property or a body of water
7under the management, supervision, or control of the department.
AB174-ASA1, s. 2 8Section 2. 23.33 (3m) of the statutes is created to read:
AB174-ASA1,1,129 23.33 (3m) Operation on department property. (a) Except as provided in par.
10(b), no person may operate an all-terrain vehicle on department property unless
11operation of all-terrain vehicles is specifically authorized by notice posted by the
12department on the department property.

1(b) A person may operate an all-terrain vehicle on any land, including any
2roadway, located on department property for the purpose of legally hunting, field
3dressing, tagging, and retrieving deer, elk, or bear if all of the following apply:
AB174-ASA1,2,54 1. The person is at least 70 years of age or holds a Class A permit or a Class B
5permit under s. 29.193 (2).
AB174-ASA1,2,76 2. The person has registered with the manager or supervisor of the department
7property prior to operating the all-terrain vehicle.
