TO 2003 ASSEMBLY BILL 203

AB203-ASA1,1,4 1An Act to amend 346.02 (6); and to create 86.19 (7) and 346.05 (1g) of the
2statutes; relating to: impeding the flow of traffic by continuously operating a
3motor vehicle in the left-most lane of a controlled-access highway and erecting
4signs stating Keep Right Except To Pass on such highways.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB203-ASA1, s. 1 5Section 1. 86.19 (7) of the statutes is created to read:
AB203-ASA1,2,46 86.19 (7) (a) After the effective date of this paragraph .... [revisor inserts date],
7on any portion of a controlled-access highway that is designated under s. 83.027 (1)
8or 84.25 (1) and on which traffic is subject to the restriction specified in s. 346.05 (1g),
9the department or a county, with respect to such controlled-access highways under
10its jurisdiction, may only erect "keep right except to pass" signs to provide warning
11to users of a highway that traffic is subject to the restriction specified in s. 346.05 (1g).
12On any portion of a controlled-access highway that is subject to this paragraph, no

1"slower traffic keep right" sign may be erected after the effective date of this
2paragraph .... [revisor inserts date]. This paragraph applies to the replacement of
3any "slower traffic keep right" sign on portions of controlled-access highways that
4are subject to this paragraph.
AB203-ASA1,2,85 (b) On any portion of a controlled-access highway identified under par. (a), any
6"slower traffic keep right" sign that is lawfully in existence on the effective date of
7this paragraph .... [revisor inserts date], shall be removed or replaced with a "keep
8right except to pass" sign by September 1, 2008.
AB203-ASA1, s. 2 9Section 2. 346.02 (6) of the statutes is amended to read:
AB203-ASA1,2,1510 346.02 (6) Applicability to persons working on highways. This chapter
11applies to persons, teams, motor vehicles and road machinery while traveling to or
12from highway construction or maintenance work but the provisions of ss. 346.05 (1g)
13and
(3), 346.06 to 346.17, 346.28, 346.29 (2), 346.31 to 346.36, 346.52 to 346.56 and
14346.59 do not apply to persons, teams, motor vehicles or road machinery when
15actually engaged in maintenance or construction work upon a highway.
AB203-ASA1, s. 3 16Section 3. 346.05 (1g) of the statutes is created to read:
AB203-ASA1,2,1917 346.05 (1g) Notwithstanding sub. (1), no person may impede the flow of traffic
18by continuously operating a motor vehicle in the left-most lane of a controlled-access
19highway with only 2 lanes of traffic in each direction.
