ASSEMBLY SUBSTITUTE AMENDMENT 1,
TO 2003 ASSEMBLY BILL 326

AB326-ASA1,1,4 1An Act to renumber 69.30 (1) (a); and to create 69.30 (1) (ag), 69.30 (1) (bd),
269.30 (1) (bf), 69.30 (1) (bh) and 69.30 (3) of the statutes; relating to:
3transmission of death certificates by funeral directors, funeral establishment
4operators, and cemetery authorities.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

AB326-ASA1, s. 1 5Section 1. 69.30 (1) (a) of the statutes is renumbered 69.30 (1) (ar).

AB326-ASA1, s. 2 6Section 2. 69.30 (1) (ag) of the statutes is created to read:

AB326-ASA1,1,77 69.30 (1) (ag) "Cemetery authority" has the meaning given in s. 157.061 (2).

AB326-ASA1, s. 3 8Section 3. 69.30 (1) (bd) of the statutes is created to read:

AB326-ASA1,1,99 69.30 (1) (bd) "Funeral director" has the meaning given in s. 445.01 (5).

AB326-ASA1, s. 4 10Section 4. 69.30 (1) (bf) of the statutes is created to read:

AB326-ASA1,1,1111 69.30 (1) (bf) "Insurer" has the meaning given in s. 600.03 (27).

AB326-ASA1, s. 5 12Section 5. 69.30 (1) (bh) of the statutes is created to read:

169.30 (1) (bh) "Operator of a funeral establishment" has the meaning given in
2s. 445.01 (7).

AB326-ASA1, s. 6 3Section 6. 69.30 (3) of the statutes is created to read:

AB326-ASA1,2,94 69.30 (3) A cemetery authority, funeral director, or operator of a funeral
5establishment, or an employee of a cemetery authority, funeral director, or operator
6of a funeral establishment, is not subject to s. 69.24 (1) (a) for copying a certified copy
7of a certificate of death for transmission to a financial institution, insurer, coroner,
8deputy coroner, medical examiner, or deputy medical examiner, if all of the following
9are satisfied:

AB326-ASA1,2,1210 (a) A personal representative, as defined in s. 851.23, or family member of the
11decedent signs a form identifying the decedent and consenting to transmission of the
12copy.

AB326-ASA1,2,1413 (b) The form specified in par. (a) is attached to the copy and is transmitted with
14the copy.

AB326-ASA1,2,1515 (c) The copy is conspicuously marked with an indication that it is a copy.

AB326-ASA1,2,1816 (d) The financial institution, insurer, coroner, deputy coroner, medical
17examiner, or deputy medical examiner gives prior consent to transmission of the
18copy.
