TO 2003 ASSEMBLY BILL 375

AB375-SA1,1,11 At the locations indicated, amend the bill as follows:
AB375-SA1,1,2 21. Page 2, line 1: before that line insert:
AB375-SA1,1,3 3" Section 1g. 23.33 (6m) of the statutes is created to read:
AB375-SA1,1,104 23.33 (6m) Accidents; duty upon striking person or attended or occupied
5vehicle.
(a) The operator of any all-terrain vehicle involved in an accident resulting
6in injury to or death of any person or in damage to a vehicle which is driven or
7attended by any person shall immediately stop such all-terrain vehicle at the scene
8of the accident or as close thereto as possible but shall then forthwith return to and
9in every event shall remain at the scene of the accident until the operator has fulfilled
10the following requirements:
AB375-SA1,2,211 1. The operator of the all-terrain vehicle shall give his or her name, address,
12and the registration number of the all-terrain vehicle he or she is operating to the

1person struck or to the operator or occupant of or person attending any vehicle
2collided with.
AB375-SA1,2,73 2. The operator of the all-terrain vehicle shall render to any person injured in
4the accident reasonable assistance, including the carrying, or the making of
5arrangements for the carrying, of such person to a physician, surgeon, or hospital for
6medical or surgical treatment if it is apparent that such treatment is necessary or
7if such carrying is requested by the injured person.
AB375-SA1,2,98 (b) Any stop required under par. (a) shall be made without obstructing traffic
9more than is necessary.
AB375-SA1, s. 1m 10Section 1m. 23.33 (7) (title) of the statutes is amended to read:
AB375-SA1,2,1111 23.33 (7) (title) Accidents; reporting.
AB375-SA1, s. 1q 12Section 1q. 23.33 (13) (cj) of the statutes is created to read:
AB375-SA1,2,1413 23.33 (13) (cj) Penalties related to leaving the scene of an accident. Any person
14who violates sub. (6m) (a):
AB375-SA1,2,1615 (a) Shall be fined not less than $300 nor more than $1,000 or imprisoned not
16more than 6 months or both if the accident did not involve death or injury to a person.
AB375-SA1,2,1917 (b) May be fined not more than $10,000 or imprisoned for not more than 9
18months or both if the accident involved injury to a person but the person did not suffer
19great bodily harm.
AB375-SA1,2,2120 (c) Is guilty of a Class E felony if the accident involved injury to a person and
21the person suffered great bodily harm.
AB375-SA1,2,2222 (d) Is guilty of a Class D felony if the accident involved death to a person.
AB375-SA1,2,2323 (e) Is guilty of a felony if the accident involved death or injury to a person.".
AB375-SA1,2,24 242. Page 2, line 1: delete " Section 1" and substitute "Section 1t".

AB375-SA1,3,2 2" Section 2g. 350.11 (1) of the statutes is amended to read:
AB375-SA1,3,53 350.11 (1) (a) Except as provided in par. (b) and subs. (2g), (2k), (2m), and (3),
4any person who violates any provision of this chapter shall forfeit not more than
5$250.
AB375-SA1,3,96 (b) Except as provided in subs. (2g), (2k), (2m) , and (3), any person who violates
7any provision of this chapter and who, within the last 3 years prior to the conviction
8for the current violation, was 2 or more times previously convicted for violating the
9same provision of this chapter shall forfeit not more than $500.
AB375-SA1, s. 2L 10Section 2L. 350.11 (2k) of the statutes is created to read:
AB375-SA1,3,1111 350.11 (2k) Any person who violates s. 350.15 (2):
AB375-SA1,3,1312 (a) Shall be fined not less than $300 nor more than $1,000 or imprisoned not

AB375-SA1,3,1614 (b) May be fined not more than $10,000 or imprisoned for not more than 9
15months or both if the accident involved injury to a person but the person did not suffer

18the person suffered great bodily harm.
AB375-SA1,3,1919 (d) Is guilty of a Class D felony if the accident involved death to a person.
AB375-SA1,3,2020 (e) Is guilty of a felony if the accident involved death or injury to a person.
AB375-SA1, s. 2p 21Section 2p. 350.15 (2) of the statutes is repealed and recreated to read:
AB375-SA1,4,422 350.15 (2) Duty upon striking person or attended or occupied vehicle. (a)
23The operator of any snowmobile involved in an accident resulting in injury to or
24death of any person or in damage to a vehicle which is driven or attended by any

1person shall immediately stop such snowmobile at the scene of the accident or as
2close thereto as possible but shall then forthwith return to and in every event shall
3remain at the scene of the accident until the operator has fulfilled the following
4requirements:
AB375-SA1,4,75 1. The operator of the snowmobile shall give his or her name, address, and the
6registration number of the snowmobile he or she is operating to the person struck or
7to the operator or occupant of or person attending any vehicle collided with.
AB375-SA1,4,128 2. The operator of the snowmobile shall render to any person injured in the
9accident reasonable assistance, including the carrying, or the making of
10arrangements for the carrying, of such person to a physician, surgeon, or hospital for
11medical or surgical treatment if it is apparent that such treatment is necessary or
12if such carrying is requested by the injured person.
AB375-SA1,4,1413 (b) Any stop required under par. (a) shall be made without obstructing traffic
14more than is necessary.".
