ASSEMBLY SUBSTITUTE AMENDMENT 1,
TO 2003 ASSEMBLY BILL 649

AB649-ASA1,1,4 1An Act to amend 230.81 (1) (b); and to repeal and recreate 230.80 (3) and
2895.65 (1) (b) of the statutes; relating to: coverage under laws prohibiting
3retaliatory action by a governmental employer against employees for disclosing
4certain information.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB649-ASA1, s. 1 5Section 1. 230.80 (3) of the statutes is repealed and recreated to read:
AB649-ASA1,1,86 230.80 (3) "Employee" means any person employed by any governmental unit
7except a person who serves at the pleasure of the governor in a position that is not
8in the office of the governor.
AB649-ASA1, s. 2 9Section 2. 230.81 (1) (b) of the statutes, as affected by 2003 Wisconsin Act 33,
10is amended to read:
AB649-ASA1,2,511 230.81 (1) (b) After asking the division of equal rights which governmental unit
12is appropriate to receive the information, disclose the information in writing only to

1the governmental unit that the division of equal rights determines is appropriate.
2The division of equal rights may not designate the department of justice , or the
3courts, the legislature or a service agency under subch. IV of ch. 13 as an appropriate
4governmental unit to receive information. Each appropriate governmental unit
5shall designate an employee to receive information under this section.
AB649-ASA1, s. 3 6Section 3. 895.65 (1) (b) of the statutes is repealed and recreated to read:
AB649-ASA1,2,77 895.65 (1) (b) "Employee" has the meaning given in s. 230.80 (3).
