TO 2003 ASSEMBLY BILL 674

AB674-ASA1-AA3,1,11 At the locations indicated, amend the substitute amendment as follows:
AB674-ASA1-AA3,1,3 21. Page 2, line 6: after "(ag)" insert "and who has satisfied the condition under
3s. 40.51 (5m)".
AB674-ASA1-AA3,1,4 42. Page 2, line 9: after that line insert:
AB674-ASA1-AA3,1,5 5" Section 1m. 40.03 (2) (rm) of the statutes is created to read:
AB674-ASA1-AA3,1,96 40.03 (2) (rm) Annually, shall submit to the chief clerk of each house of the
7legislature, for distribution to the legislature under s. 13.172 (2), a report specifying
8the number of eligible employees, as defined in s. 40.02 (25) (b) 5m., that are
9employed at each state agency.".

140.51 (5m) No employer may agree, in writing, to pay employer contributions
2toward the premium costs of health insurance coverage under s. 40.05 (4) (ag) for an
3eligible employee, as defined in s. 40.02 (25) (b) 5m., unless the employer is unable
4to employ any other qualified individual with a comparable employment background
5and experience and one of the following occurs:
AB674-ASA1-AA3,2,96 (a) If the eligible employee is employed in an office, department, or independent
7agency in the executive branch of state government or in an authority specified in
8s. 40.02 (54) (b) to (i), the secretary of administration, or his or her designee, must
9approve the payment of employer contributions for that eligible employee.
AB674-ASA1-AA3,2,1310 (b) If the eligible employee is employed in an office, department, or independent
11agency in the judicial branch of state government, the chief justice of the supreme
12court, or his or her designee, must approve the payment of employer contributions
13for that eligible employee.
AB674-ASA1-AA3,2,1614 (c) If the eligible employee's salary is paid from the appropriation account
15under s. 20.765 (1) (a), the speaker of the assembly must approve the payment of
16employer contributions for that eligible employee.
AB674-ASA1-AA3,2,1917 (d) If the eligible employee's salary is paid from the appropriation account
18under s. 20.765 (1) (b), the senate majority leader must approve the payment of
19employer contributions for that eligible employee.
AB674-ASA1-AA3,2,2320 (e) If the eligible employee is employed by a legislative service agency, as
21defined in s. 16.70 (6), the speaker of the assembly and the senate majority leader
22must jointly approve the payment of employer contributions for that eligible
23employee.".
