ASSEMBLY AMENDMENT 1, TO 2003 ASSEMBLY BILL 744

AB744-AA1,1,1 At the locations indicated, amend the bill as follows:

AB744-AA1,1,2 1. Page 1, line 2: after "driving" insert "and providing a penalty".

AB744-AA1,1,3 2. Page 2, line 3: after that line insert:

AB744-AA1,1,4 " Section 1m. 346.89 (2) of the statutes is amended to read:

AB744-AA1,2,2 346.89 (2) No person shall drive any motor vehicle , other than an authorized emergency vehicle, a commercial motor vehicle described in s. 340.01 (8), or a tow truck, equipped with any device for visually receiving displaying a television, cable television, or satellite broadcast, film, or other fluctuating video image, whether in broadcast, tape recorded, or optically or electronically recorded format, when such device is located in the motor vehicle at any point forward of the back of the operator's seat or when such device is visible to the operator while driving the motor vehicle. This subsection does not apply to any device in a vehicle that is intended for the exclusive display of information related to the operation, navigation, or condition of the vehicle or that is intended to be used solely to enhance safety while backing the vehicle.".

AB744-AA1,2,3 3. Page 2, line 4: delete that line and substitute:

AB744-AA1,2,4 " Section 2g. 346.89 (3) of the statutes is created to read:".

AB744-AA1,2,5 4. Page 2, line 5: delete " (2)" and substitute "(3)".

AB744-AA1,2,7 5. Page 2, line 6: after "vehicle" insert ", a commercial motor vehicle described in s. 340.01 (8), or a tow truck".

AB744-AA1,2,13 6. Page 2, line 6: delete the material beginning with "device" and ending with "person." on line 10 and substitute "electronic device located within the vehicle that is activated and that is transmitting information or providing entertainment primarily by visual means. This subsection does not prohibit a person from using a cellular telephone or other wireless telecommunications device for purposes of verbal communication.".

AB744-AA1,2,15 8. Page 2, line 11: delete "by the manufacturer or a dealer".

AB744-AA1,2,16 9. Page 2, line 12: after "operation" insert ", navigation,".

AB744-AA1,2,17 10. Page 2, line 13: after that line insert:

AB744-AA1,2,18 " Section 2m. 346.95 (1) of the statutes is amended to read:

AB744-AA1,2,22 346.95 (1) Any person violating s. 346.87, 346.88, 346.89 (2) or (3), 346.90 to 346.92 or 346.94 (1), (9), (10), (11), (12) or (15) may be required to forfeit not less than $20 nor more than $40 for the first offense and not less than $50 nor more than $100 for the 2nd or subsequent conviction within a year.".
