ASSEMBLY AMENDMENT 2, TO 2003 ASSEMBLY BILL 748

AB748-AA2,1,1 At the locations indicated, amend the bill as follows:

AB748-AA2,1,3 1. Page 3, line 9: after "(c)" insert "and provides notice of the permit application to the owner of any adjacent property as required under par. (c) 2".

AB748-AA2,1,4 2. Page 3, line 21: after "(c)" insert "1.".

AB748-AA2,1,6 3. Page 4, line 1: delete the material beginning with "The department" and ending with "application." on line 2.

AB748-AA2,1,7 4. Page 4, line 3: before that line insert:

AB748-AA2,1,10 "2. Any person who makes application for a permit under this paragraph shall, at the time of the application, provide written notice of the application to the owner of any property adjacent to the vegetation specified in the permit application.

AB748-AA2,2,5 3. Within 30 days of receipt of an application under this paragraph, the department shall inform the applicant whether the application is complete and, if not, what information, specifically described, must be provided by the applicant to the department to complete the application. The department shall grant or deny an application for a permit under this paragraph within 30 days of notifying the applicant that the application is complete or, if the department notifies the applicant that additional information is necessary to complete the application, within 30 days of receipt by the department of all such additional information.

AB748-AA2,2,9 4. Any person aggrieved by a decision of the department under this paragraph is entitled, upon request, to a contested case hearing before the division of hearings and appeals in the department of administration, and to judicial review thereof, in accordance with ch. 227.

AB748-AA2, s. 2m Section 2m. 227.43 (1) (bg) of the statutes is amended to read:
