ASSEMBLY AMENDMENT 2, TO 2003 SENATE BILL 120

SB120-AA2,1,1 At the locations indicated, amend the engrossed bill as follows:

SB120-AA2,1,2 1. Page 4, line 18: after that line insert:

SB120-AA2,1,3 " Section 3m. 66.0312 of the statutes is created to read:

SB120-AA2,1,5 66.0312 Local health departments; mutual assistance. (1) In this section "local health department" has the meaning given in s. 66.0314 (1) (e).

SB120-AA2,1,8 (2) (a) Subject to sub. (3), upon the request of a local health department, the personnel of any other local health department may assist the requester within the requester's jurisdiction, notwithstanding any other jurisdictional provision.

SB120-AA2,1,10 (b) If a request for assistance is made under par. (a), payment for the requested services shall be made by one of the following methods:

SB120-AA2,1,13 1. If an agreement under s. 66.0301, or any other agreement between the parties, for the payment of such services exists, the terms of the agreement shall be followed.

SB120-AA2,2,4 2. If no agreement described under subd. 1. for the payment of such services exists, the governmental unit that receives the assistance is responsible for the personnel or equipment costs incurred by the responding agency if the responding agency requests payment of those costs.

SB120-AA2,2,6 (3) This section does not apply during a state of emergency declared by the governor under s. 166.03 (1) (b) 1.".

SB120-AA2,2,8 2. Page 5, line 1: delete lines 1 and 2 and substitute: "66.0314 State of emergency; mutual assistance. (1) In this section:".

SB120-AA2,2,10 3. Page 5, line 19: delete "Upon" and substitute "If the governor declares a state of emergency under s. 166.03 (1) (b) 1., upon".

SB120-AA2,2,11 4. Page 5, line 24: delete "payment for the requested".

SB120-AA2,2,15 5. Page 5, line 25: delete the material beginning with that line and ending with page 6, line 15 and substitute "the governmental unit that receives the assistance is responsible for the personnel or equipment costs incurred by the responding agency if all of the following apply:

SB120-AA2,2,17 1. The responding agency meets the personnel and equipment requirements in the state plan under s. 166.03 (2) (a) 1.

SB120-AA2,2,18 2. The responding agency requests payment of those costs.".
