SENATE AMENDMENT 1, TO 2003 SENATE BILL 120

SB120-SA1,1,1 At the locations indicated, amend the bill as follows:

SB120-SA1,1,3 1. Page 1, line 7: delete the material beginning with "threats" and ending with "penalty" on line 9 and substitute "and making appropriations".

SB120-SA1,1,5 2. Page 4, line 6: after "boards," insert "federally recognized American Indian tribes or bands in this state,".

SB120-SA1,1,7 3. Page 5, line 22: after "response" insert ", which may include authorities designated by a participating tribe or band".

SB120-SA1,1,9 4. Page 5, line 23: after "s. 250.01 (4)" insert ", and also includes an entity designated by a participating tribe or band as a local health department".

SB120-SA1,1,10 5. Page 5, line 23: after that line insert:

SB120-SA1,1,12 "(fe) "Tribe or band" means a federally recognized American Indian tribe or band in this state.".

SB120-SA1,1,13 6. Page 5, line 24: after " (2)" insert "(a)".

SB120-SA1,2,1 7. Page 6, line 3: delete "The program or department".

SB120-SA1,2,2 8. Page 6, line 4: delete lines 4 and 5.

SB120-SA1,2,5 "(b) If a request for assistance is made under par. (a), payment for the requested services shall be made by one of the following methods:

SB120-SA1,2,7 1. Subject to subd. 2., if an agreement under s. 66.0301 for the payment of such services exists, the terms of the agreement shall be followed.

SB120-SA1,2,14 2. If an agreement described under subd. 1. specifies that the responding agency is responsible for any personnel or equipment costs incurred in responding to a request for assistance and if a state plan as described under s. 166.03 (2) (a) 1. is in effect and the request for assistance is made under the plan, the governmental unit that receives the assistance is responsible for the personnel or equipment costs incurred by the responding agency if the responding agency meets the personnel and equipment requirements in the plan.

SB120-SA1,2,17 3. If no agreement under s. 66.0301 for the payment of such services exists, the governmental unit that receives the assistance is responsible for the personnel or equipment costs incurred by the responding agency.".
