1An Act to repeal 101.651 (2m) (b), 101.651 (3m) and 101.651 (6);
to amend
2101.63 (3), 101.651 (title), 101.651 (2m) (c), 101.651 (3) (a) and 101.651 (3) (b);

to repeal and recreate 101.651 (2m) (title) of the statutes;
relating to:
4enforcement of the one- and two-family dwelling code in certain cities, villages,
5and towns.
The people of the state of Wisconsin, represented in senate and assembly, do

(2m) (c) Under sub. (3) (b), the department enforces this subchapter
6or an ordinance enacted under s. 101.65 (1) (a) throughout the municipality and
7provides inspection services in the municipality to administer and enforce this
8subchapter

6. 101.651 (3) (a) of the statutes is amended to read:

(3) (a) Except as provided in par. (b)
or sub. (3m), the department or
11a county may not enforce this subchapter
or an ordinance enacted under s. 101.65
12(1) (a) or provide inspection services in a municipality unless requested to do so by
13a person with respect to a particular dwelling or by the municipality. A request by
14a person or a municipality with respect to a particular dwelling does not give the
15department or a county authority with respect to any other dwelling. Costs shall be
16collected under s. 101.65 (1) (c) or ss. 101.63 (9) and 101.65 (2) from a person or
17municipality making a request under this subsection.

21any municipality that does not exercise jurisdiction under sub. (2m) and that has not
22adopted a resolution under sub. (2m) (a)
