4"(b) The prohibition in par. (a) does not apply until the earlier of the following:

2. The date on which the county and, as appropriate, a town, village, or city has
7issued all necessary approvals for the siting within the counties of Brown,
8Outagamie, or Winnebago of a facility for the vitrification of sediments containing
9PCBs removed from the bed of water bodies in the Fox River system as part of a
10remedial action required under s. 292.11 or 292.31 or under the federal
11Comprehensive Environmental Response, Compensation, and Liability Act,

9675.".

2(1) The department of natural resources shall include, as part of its 2007-09
3biennial budget request that it submits to the department of administration under
4section 16.42 of the statutes, a proposal for a program to assist in the development
5of a facility for the vitrification of sediments containing PCBs, as defined in section
6299.45 (1) (a) of the statutes, removed from the bed of water bodies in the Fox River
7system as part of a remedial action required under s. 292.11 or 292.31 of the statutes
8or under the federal Comprehensive Environmental Response, Compensation, and
9Liability Act,

9675. The department shall include in the proposed
10program technical assistance to developers of the vitrification technology and
11appropriate financial assistance or incentives.".
