ASSEMBLY AMENDMENT 4, TO 2005 ASSEMBLY BILL 409

AB409-AA4,1,1 At the locations indicated, amend the bill as follows:

AB409-AA4,1,2 1. Page 5, line 6: before "The" insert "(a)".

AB409-AA4,1,4 2. Page 5, line 7: delete the material beginning with "if" and ending with "350," on line 9 and substitute "if par. (b) applies,".

AB409-AA4,1,6 3. Page 5, line 13: delete the material beginning with "For" and ending with "law." on line 15.

AB409-AA4,1,7 4. Page 5, line 15: after that line insert:

AB409-AA4,1,11 "(b) The department and its wardens may exercise its authority under this subsection for a violation of s. 943.13 only if there is probable cause to believe that the person is violating at the same time a provision of this chapter or a provision of ch. 23, 26, 27, 28, 169, or 350.

AB409-AA4,2,3 (c) For purposes of the subsection, any warden may stop and board any boat and stop any vehicle if the warden reasonably suspects there is both a violation of s. 943.13 and a violation of this chapter or ch. 23, 26, 27, 28, 169, or 350.".

AB409-AA4,2,4 5. Page 10, line 19: delete lines 19 and 20 and substitute:

AB409-AA4,2,7 "(b) If a person is convicted of a violation of this section as a result of the department, or its wardens, exercising its authority under s. 29.921 (4m), the court may revoke or".
