SENATE AMENDMENT 4, TO 2005 ASSEMBLY BILL 461

AB461-SA4,1,1 At the locations indicated, amend the bill as follows:

AB461-SA4,1,3 1. Page 2, line 3: delete "The governor" and substitute "(1) Except as provided under sub. (2), the governor".

AB461-SA4,1,4 2. Page 2, line 9: after that line insert:

AB461-SA4,1,12 "(2) The governor may concur with a determination of the U.S. secretary of the interior, under 25 USC 2719 (b) (1) (A), that a gaming establishment proposed to be located on lands acquired by the U.S. secretary of the interior in trust for the benefit of an Indian tribe after October 17, 1988, would be in the best interest of the Indian tribe and its members and would not be detrimental to the surrounding community without the legislature first concurring in the determination by joint resolution if, before the effective date of this subsection .... [revisor inserts date], all of the following conditions are satisfied:

AB461-SA4,2,3 (a) The electorate in the municipality where the gaming establishment is proposed to be located approved, by referendum, locating a gaming establishment in the municipality.

AB461-SA4,2,5 (b) An Indian tribe notified the federal bureau of Indian affairs of its desire to locate a gaming establishment on the lands.".
