ASSEMBLY AMENDMENT 2, TO ASSEMBLY SUBSTITUTE AMENDMENT 1, TO 2005 ASSEMBLY BILL 534

AB534-ASA1-AA2,1,1 At the locations indicated, amend the substitute amendment as follows:

AB534-ASA1-AA2,1,3 1. Page 3, line 11: delete "If" and substitute "Except as provided in subd. 2m., if".

AB534-ASA1-AA2,1,4 2. Page 3, line 20: after that line insert:

AB534-ASA1-AA2,1,8 "2m. If a municipality or a local school district expresses interest in acquiring the land for public use related to transportation or infrastructure, the department may offer the municipality or the local school district the right of first purchase, for less than the fair market valuation of the property, if all of the following are true:

AB534-ASA1-AA2,1,11 a. The municipality or local school district provides a plan to the department identifying the proposed use of the property for transportation or infrastructure purposes.

AB534-ASA1-AA2,2,2 b. The municipality or local school district agrees to a permanent restriction on the use of the land for the purpose identified.".

AB534-ASA1-AA2,2,5 3. Page 3, line 23: after "parcel." insert "If the conditions of subd. 2m. are met, the department shall transfer ownership of the land parcel to the municipality or local school district upon receipt of the agreed purchase price of the land parcel.".
