AB990-ASA1,1,2 An Act to amend 973.047 (1f) of the statutes; relating to: deoxyribonucleic acid testing of criminals.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

AB990-ASA1, s. 1 Section 1. 973.046 (1r) of the statutes is amended to read:

AB990-ASA1,1,6 973.046 (1r) If a court imposes a sentence or places a person on probation for a violation of s. 940.225, 944.20, 948.02 (1) or (2) or, 948.025, or 948.10, the court shall impose a deoxyribonucleic acid analysis surcharge of $250.

AB990-ASA1, s. 2 Section 2. 973.047 (1f) of the statutes is amended to read:

AB990-ASA1,1,11 973.047 (1f) If a court imposes a sentence or places a person on probation for a felony conviction or for a conviction for a violation of s. 940.225 (3m), 944.20, or 948.10, the court shall require the person to provide a biological specimen to the state crime laboratories for deoxyribonucleic acid analysis.

AB990-ASA1, s. 3 Section 3. Initial applicability.

AB990-ASA1,2,4 (1) The treatment of section 973.047 (1f) of the statutes first applies to convictions entered and to persons who are serving the confinement portion of any sentence or who are on parole, probation, or extended supervision on the effective date of this subsection.

AB990-ASA1,2,6 (2) The treatment of section 973.046 (1r) of the statutes first applies to persons who are sentenced or placed on probation on the effective date of this subsection.

AB990-ASA1, s. 4 Section 4. Effective date.

AB990-ASA1,2,9 (1) This act takes effect on the first day of the 2nd month beginning after publication.
