TO 2005 ASSEMBLY JOINT RESOLUTION 77

AJR77-SA1,1,21 At the locations indicated, amend the joint resolution, as shown by assembly
2substitute amendment 5, as follows:
AJR77-SA1,1,3 31. Page 3, line 3: delete lines 3 to 8 and substitute:
AJR77-SA1,1,11 4"(6) (a) A local governmental unit need not comply with any state law or
5administrative rule that requires the expenditure of money by the local
6governmental unit unless the state provides for the payment to the local
7governmental unit of an amount that is equal to the reasonable costs incurred by the
8local governmental unit to comply with the law or rule, as determined by the
9governing body of the local governmental unit. This paragraph does not apply to any
10law or rule that is enacted or adopted in order to comply with a requirement of federal
11law, including a requirement related to receiving federal aid.
AJR77-SA1,2,412 (b) No sales or use tax exemption may be enacted after the ratification of this
13paragraph unless the state pays to each local governmental unit, for each year in

1which the exemption is in effect, an amount that is equal to the difference between
2the amount of sales and use tax revenue that the local governmental unit collected
3and the amount of sales and use tax revenue that the local governmental unit would
4have collected if the exemption had not been in effect.
AJR77-SA1,2,105 (c) No property tax exemption may be enacted after the ratification of this
6paragraph unless the state pays to each local governmental unit, for each year in
7which the exemption is in effect, an amount that is equal to the amount of property
8tax revenue that the local governmental unit would have collected from every
9taxpayer located within the jurisdiction of the local governmental unit, for property
10tax purposes, who is subject to the exemption if the exemption had not been in effect.
AJR77-SA1,2,1511 (d) In each fiscal year, beginning in 2010, the state shall pay two-thirds of the
12public education costs for students in kindergarten through the 12th grade,
13including the costs of providing a voucher program for students to attend private
14schools. Amounts paid under this paragraph are excluded from the calculation of the
15state's revenue limit.
AJR77-SA1,2,1816 (e) In each fiscal year, beginning in 2010, the state shall pay one-third of the
17cost of operating technical colleges in this state. Amounts paid under this paragraph
18are excluded from the calculation of the state's revenue limit.".
