SENATE AMENDMENT 2, TO 2005 SENATE BILL 447

SB447-SA2,1,1 At the locations indicated, amend the bill as follows:

SB447-SA2,1,2 1. Page 2, line 9: after that line insert:

SB447-SA2,1,3 " Section 3m. 895.85 (4) (a) of the statutes is amended to read:

SB447-SA2,1,6 895.85 (4) (a) The plaintiff may introduce evidence of the wealth of a defendant and may introduce evidence of the penalty that was imposed on the defendant as the result of being convicted of an offense that is relevant to the subject of the case; and

SB447-SA2, s. 3r Section 3r. 895.85 (4r) of the statutes is created to read:

SB447-SA2,1,10 895.85 (4r) Disposition of punitive damages. If the court awards punitive damages, the court shall order that the plaintiff receive one-half of the amount awarded and that the remaining one-half be deposited in the school fund.".
