SB530-AA1,1,11 At the locations indicated, amend the bill as follows:
SB530-AA1,1,2 21. Page 2, line 8: after that line insert:
SB530-AA1,1,4 3" Section 1m. 346.65 (2) (b) of the statutes, as affected by 2005 Wisconsin Act

6less than $350 nor more than $1,100 and imprisoned for not less than 5 days nor more
7than 6 months if the number of convictions under ss. 940.09 (1) and 940.25 in the
8person's lifetime, plus the total number of suspensions, revocations, and other
9convictions counted under s. 343.307 (1) within a 10-year period, equals 2, except
10that suspensions, revocations, or convictions arising out of the same incident or

4there was a minor passenger under 16 years of age in the motor vehicle at the time
5of the violation that gave rise to the conviction under s. 346.63 (2) or (6), the offense
6is a felony, the applicable minimum and maximum fines or periods of imprisonment
7for the conviction are doubled and the place of imprisonment shall be determined
8under s. 973.02.".

1973.11 (1) Placements. (intro.) If a person is convicted of or pleads guilty or
2no contest to one or more misdemeanors for which either mandatory periods of
3imprisonment are not required or the person is sentenced under s. 346.65 (2) (bm)
4or (cm), (2j) (bm) or (cm), or (3r)
, if the chief judge of the judicial administrative
5district has approved a volunteers in probation program established in the
6applicable county, and if the court decides that volunteer supervision under the
7program will likely benefit the person and the community and subject to the
8limitations under sub. (3), the court may withhold sentence or judgment of conviction
9and order that the person be placed with that volunteers in probation program. A
10person's participation in the program may not be used to conceal, withhold, or mask
11information regarding the judgment of conviction if the conviction is required to be
12included in a record kept under s. 343.23 (2) (a). Except as provided in sub. (3), the
13order shall provide any conditions that the court determines are reasonable and
14appropriate and may include, but need not be limited to, one or more of the
15following:".

18publication, except as follows:

21973.11 (1) (intro.) (by Section 11n) of the statutes and the repeal of sections 346.65
22(2) (bm) and (cm), (2j) (bm) and (cm), (3r), and (8) of the statutes take effect on the
23first day of the 72nd month beginning after publication.".
