ASSEMBLY AMENDMENT 1, TO 2005 SENATE BILL 567

SB567-AA1,1,1 At the locations indicated, amend the bill as follows:

SB567-AA1,1,3 1. Page 2, line 1: delete the material beginning with that line and ending with page 3, line 5, and substitute:

SB567-AA1,1,5 " Section 1c. 49.84 (5) of the statutes is renumbered 49.84 (5) (c) (intro.) and amended to read:

SB567-AA1,1,11 49.84 (5) (c) (intro.) A Notwithstanding any other eligibility requirements specified in this chapter, to the extent permitted under federal law, any person applying for Wisconsin works under ss. 49.141 to 49.161, aid to families with dependent children under s. 49.19, medical assistance under subch. IV or food stamp program benefits under 7 USC 2011 to 2029 any program under this chapter shall, as do all of the following:

SB567-AA1,2,2 1. As a condition of initial eligibility, provide a declaration and other verification of citizenship or satisfactory immigration status as required by rule by the department by rule administering the program or as required in 42 USC 1320b-7 (d).".

SB567-AA1,2,3 2. Page 3, line 11: after that line insert:

SB567-AA1,2,4 " Section 2f. 49.84 (5) (b) of the statutes is created to read:

SB567-AA1,2,9 49.84 (5) (b) Notwithstanding any other eligibility requirements specified in this chapter and except as provided in s. 49.45 (27), to the extent permitted under federal law only a person who is a U.S. citizen or an alien lawfully admitted for permanent residence or otherwise permanently residing in the United States under color of law shall be eligible for a program under this chapter.

SB567-AA1, s. 2m Section 2m. 49.84 (5) (c) 2. of the statutes is created to read:

SB567-AA1,2,15 49.84 (5) (c) 2. As a condition of continued eligibility, within 60 days after being determined initially eligible or within a reasonable time established by rule by the department administering the program, provide documentary proof of citizenship or satisfactory immigration status as required by rule by the department administering the program or as required in 42 USC 1320b-7 (d).".
