TO 2005 SENATE BILL 95

SB95-ASA1,1,2 1An Act to amend 447.05; and to create 447.055 of the statutes; relating to:
2continuing education for dental hygienists.

Under current law, dental hygienists licensed by the Dentistry Examining
Board (board) must apply to renew their licenses every two years. This substitute
amendment prohibits the board from renewing a license unless a dental hygienist
attests that he or she has complied with continuing education requirements created
by the substitute amendment. In addition, when applying for renewal, a dental
hygienist must attest that he or she has a current certification in cardiopulmonary
resuscitation.
Regarding continuing education, the substitute amendment requires an
applicant for renewal to teach, prepare, attend, or otherwise complete, during the
two years preceding renewal, 12 credit hours of continuing education, including
training in basic life support, cardiopulmonary resuscitation, and infection control.
This requirement does not apply the first time that a person applies to renew a
license, but applies each time thereafter. The required hours may be satisfied by
independent study, correspondence, or Internet courses or programs. Not more than
two of the required credit hours may be satisfied by training in basic life support or
cardiopulmonary resuscitation, and not less than two hours must be satisfied by
training in infection control.
The substitute amendment requires the Department of Regulation and
Licensing (DRL) to biennially consult with the board and the Department of Health

and Family Services (DHFS) regarding the number of credit hours of continuing
education required for renewal. After consultation, DRL may promulgate a rule
setting the number of hours required for renewal between 12 and 20. Also after
consulting with the board and with DHFS, DRL may promulgate rules requiring
credit hours in specific clinical subjects. Under the substitute amendment, the board
may require proof of compliance with the continuing education requirements.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB95-ASA1, s. 1 1Section 1. 447.05 of the statutes is amended to read:
SB95-ASA1,2,9 2447.05 Expiration and renewal. Renewal applications shall be submitted
3to the department on a form provided by the department on or before the applicable
4renewal date specified under s. 440.08 (2) (a) and shall include the applicable
5renewal fee specified under s. 440.08 (2) (a). The examining board may not renew
6a license to practice dental hygiene unless the applicant for renewal attests that he
7or she has complied with s. 447.055 and any rules promulgated by the department
8under s. 447.055 and that he or she has a current certification in cardiopulmonary
9resuscitation.
SB95-ASA1, s. 2 10Section 2. 447.055 of the statutes is created to read:
SB95-ASA1,2,18 11447.055 Continuing education. (1) (a) Except as provided in subs. (3) and
12(4), a person is not eligible for renewal of a license to practice dental hygiene unless
13the person has taught, prepared, attended, or otherwise completed, during the
142-year period immediately preceding the renewal date specified under s. 440.08 (2)
15(a), 12 credit hours of continuing education relating to the clinical practice of dental
16hygiene that is sponsored or recognized by a local, state, regional, national, or
17international dental, dental hygiene, dental assisting, or medical-related
18professional organization.

1(b) Continuing education required under par. (a) may include training in all of
2the following:
SB95-ASA1,3,43 1. Basic life support or cardiopulmonary resuscitation. Not more than 2 of the
4credit hours required under par. (a) may be satisfied by such training.
SB95-ASA1,3,65 2. Infection control. Not less than 2 of the credit hours required under par. (a)
6must be satisfied by such training.
SB95-ASA1,3,137 (c) Biennially, beginning January 1, 2007, the department shall consult with
8the examining board and with the department of health and family services
9regarding the number of credit hours of continuing education required for eligibility
10for renewal under par. (a). After consulting with the examining board and the
11department of health and family services, and notwithstanding par. (a), the
12department may promulgate a rule requiring not more than 20 nor less than 12
13credit hours of continuing education for eligibility for renewal.
SB95-ASA1,3,1714 (d) After consultation with the examining board and with the department of
15health and family services, the department may promulgate rules requiring that
16continuing education credit hours under par. (a) include courses in specific clinical
17subjects.
SB95-ASA1,3,19 18(2) The credit hours required under sub. (1) (a) may be satisfied by independent
19study, correspondence, or Internet programs or courses.
SB95-ASA1,3,22 20(3) Subsection (1) (a) does not apply to an applicant for renewal of a license that
21expires on the first renewal date after the date on which the examining board
22initially granted the license.
SB95-ASA1,4,2 23(4) A person may substitute credit hours of college level courses related to the
24practice of dental hygiene for the credit hours required under sub. (1) (a). For

1purposes of this subsection, one credit hour of a college level course is equivalent to
26 credit hours of continuing education.
SB95-ASA1,4,6 3(5) For purposes of sub. (1) (a), one hour of teaching or preparing a continuing
4education program is equivalent to one credit hour of continuing education, but a
5person who teaches or prepares a continuing education program may obtain credit
6for the program only once.
SB95-ASA1,4,9 7(6) The examining board may require applicants for renewal of a license to
8practice dental hygiene to submit proof of compliance with the requirements of this
9section.
SB95-ASA1, s. 3 10Section 3. Effective date.
SB95-ASA1,4,1211 (1) This act takes effect on November 1, 2005, or on the day after publication,
12whichever is later.
