ASSEMBLY AMENDMENT 1, TO 2007 ASSEMBLY BILL 196

AB196-AA1,1,1 At the locations indicated, amend the bill as follows:

AB196-AA1,1,2 1. Page 1, line 3: after "consumption" insert "and providing a penalty".

AB196-AA1,1,3 2. Page 2, line 5: delete lines 5 to 8 and substitute:

AB196-AA1,1,8 "125.075 (1) (intro.) Any person who procures alcohol beverages for or sells, dispenses, or gives away alcohol beverages to a person under 18 years of age, or to a person at least 18 years of age but less than 21 years of age on premises for which a retail license or permit has been issued under this chapter, in violation of s. 125.07 (1) (a) 1. or 2. may be penalized as provided in sub. (2) if:".

AB196-AA1,1,9 3. Page 2, line 8: after that line insert:

AB196-AA1,1,10 " Section 2g. 125.075 (2) of the statutes is amended to read:

AB196-AA1,1,13 125.075 (2) (a) Whoever violates sub. (1) is guilty of a Class H felony if the underage person is under 18 years of age and suffers great bodily harm, as defined in s. 939.22 (14).

AB196-AA1,2,2 (b) Whoever violates sub. (1) is guilty of a Class G felony if the underage person is under 18 years of age and dies.

AB196-AA1, s. 2r Section 2r. 125.075 (2) (c) and (d) of the statutes are created to read:

AB196-AA1,2,8 125.075 (2) (c) Whoever violates sub. (1) is subject to the penalty specified in s. 939.51 (3) (a) for a Class A misdemeanor if the underage person is 18, 19, or 20 years of age and suffers great bodily harm, as defined in s. 939.22 (14), and if the violation of sub. (1) occurs on premises for which a retail license or permit has been issued under this chapter.

AB196-AA1,2,12 (d) Whoever violates sub. (1) shall be fined not more than $10,000 or imprisoned for not more than one year in the county jail or both if the underage person is 18, 19, or 20 years of age and dies and if the violation of sub. (1) occurs on premises for which a retail license or permit has been issued under this chapter.".
