ASSEMBLY AMENDMENT 1, TO 2007 ASSEMBLY BILL 834

AB834-AA1,1,1 At the locations indicated, amend the bill as follows:

AB834-AA1,1,2 1. Page 5, line 19: delete lines 19 to 22 and substitute:

AB834-AA1,1,3 " Section 16b. 101.123 (1) (g) of the statutes is amended to read:

AB834-AA1,1,7 101.123 (1) (g) "Retail establishment" means any store or shop in which retail sales is the principal business conducted, except a tavern operating under a "Class B" intoxicating liquor license or Class "B" fermented malt beverages license, and except bowling centers.

AB834-AA1, s. 16d Section 16d. 101.123 (1) (g) of the statutes, as affected by 2007 Wisconsin Act .... (this act), is amended to read:

AB834-AA1,1,12 101.123 (1) (g) "Retail establishment" means any store or shop in which retail sales is the principal business conducted, except a tavern operating under a "Class B" intoxicating liquor license or Class "B" fermented malt beverages license.".

AB834-AA1,1,13 2. Page 9, line 10: delete "or tavern".

AB834-AA1,2,1 3. Page 9, line 18: after that line insert:

AB834-AA1,2,3 " Section 44m. 101.123 (2m) (c) 2. of the statutes, as created by 2007 Wisconsin Act .... (this act), is amended to read:

AB834-AA1,2,5 101.123 (2m) (c) 2. Refusing to serve a person, if the person is smoking in a restaurant or tavern.".

AB834-AA1,2,6 4. Page 14, line 17: delete lines 17 and 18 and substitute:

AB834-AA1,2,8 " Section 70d. Effective dates. This act takes effect on January 1, 2009, except as follows:

AB834-AA1,2,11 (1) The treatment of section 101.123 (1) (g) (by Section 16d) and (im) and (2) (a) 7m. of the statutes and the amendment of section 101.123 (2m) (c) 2. of the statutes take effect on July 1, 2011.".
