ASSEMBLY AMENDMENT 2, TO 2007 ASSEMBLY BILL 874

AB874-AA2,1,1 At the locations indicated, amend the bill as follows:

AB874-AA2,1,2 1. Page 2, line 7: delete "Class G" and substitute "Class I".

AB874-AA2,1,3 2. Page 2, line 8: delete lines 8 to 13 and substitute:

AB874-AA2,1,4 " Section 3g. 943.50 (4) (a) of the statutes is amended to read:

AB874-AA2,1,6 943.50 (4) (a) A Class A misdemeanor, if the value of the merchandise does not exceed $2,500 $1,500.

AB874-AA2, s. 3m Section 3m. 943.50 (4) (bf) of the statutes is amended to read:

AB874-AA2,1,12 943.50 (4) (bf) A Class I felony, if the value of the merchandise exceeds $2,500 $1,500 but does not exceed $5,000 or if the person violates this section with the intent to sell the merchandise on the Internet. It is prima facie evidence that the person intends to sell the merchandise on the Internet if, within 90 days preceding the violation, the person sold the same or similar kind of merchandise on the Internet.".
