ASSEMBLY AMENDMENT 1, TO 2007 ASSEMBLY BILL 89

AB89-AA1,1,1 At the locations indicated, amend the bill as follows:

AB89-AA1,1,3 1. Page 3, line 21: delete "the material beginning with "if" and ending with "aircraft" on line 22.

AB89-AA1,1,5 2. Page 4, line 12: after "aeronautics" insert "including, if applicable, regulations regarding commercial agricultural operations".

AB89-AA1,1,6 3. Page 4, line 18: after that line insert:

AB89-AA1,1,7 " Section 7m. 114.09 (1) (c) of the statutes is created to read:

AB89-AA1,1,13 114.09 (1) (c) Any person operating an aircraft in the air or on the ground or water is deemed to have given consent, pursuant to 14 CFR 91.17, to have his or her blood, breath, or urine tested for the purpose of determining the presence or quantity in his or her blood, breath, or urine, of alcohol, controlled substances, controlled substance analogs, or other drugs, or any combination thereof, when requested or required to do so by a law enforcement officer.".

AB89-AA1,2,2 4. Page 8, line 16: delete "department of transportation" and substitute "court".

AB89-AA1,2,5 5. Page 8, line 23: delete the material beginning with "in" and ending with "convictions" on line 24 and substitute ", and the violation resulted in bodily harm to another person".

AB89-AA1,2,6 6. Page 8, line 24: after that line insert:

AB89-AA1,2,9 "(d) In determining a penalty under this subsection, the court may request information about and consider the person's certification record with the federal aviation administration.".

AB89-AA1,2,10 7. Page 8, line 25: delete that line.

AB89-AA1,2,11 8. Page 9, line 1: delete lines 1 to 5.
