SENATE AMENDMENT 2, TO 2007 SENATE BILL 379

SB379-SA2,1,1 At the locations indicated, amend the bill as follows:

SB379-SA2,1,2 1. Page 2, line 5: after "101.973 (7)," insert "167.35 (2) (f),".

SB379-SA2,1,3 2. Page 4, line 21: substitute "$1,000" for "$250".

SB379-SA2,1,4 3. Page 4, line 21: substitute "brand family" for "type".

SB379-SA2,1,8 4. Page 4, line 22: after "(a)." insert "The fee shall apply to all cigarettes within the brand family and shall include any new cigarette that is included in the 3-year certification period for which the fee is paid. The manufacturer shall pay the fee upon filing each certification for a new brand family.".

SB379-SA2,1,9 5. Page 5, line 3: after "(a)" insert "or (d)".

SB379-SA2,1,10 6. Page 7, line 25: after that line insert:

SB379-SA2,1,13 "(em) Additional testing. This subsection does not require additional testing if the cigarettes have been tested for another purpose with methods that are in accordance with the testing methods recognized under this subsection.".

SB379-SA2,2,2 7. Page 8, line 11: delete the material beginning with "a modification" and ending with "printed" on line 12 and substitute "located".

SB379-SA2,2,3 8. Page 8, line 14: substitute "marking" for "visible mark".

SB379-SA2,2,4 9. Page 10, line 17: delete lines 17 to 19.

SB379-SA2,2,6 10. Page 12, line 8: delete "in violation of this section" and substitute "that have not been marked as provided in sub. (4)".

SB379-SA2,2,7 11. Page 12, line 9: after "All" insert "seized".

SB379-SA2,2,8 12. Page 12, line 10: delete "seized for violating this section".

SB379-SA2,2,9 13. Page 13, line 9: delete lines 9 to 12.

SB379-SA2,2,11 14. Page 13, line 14: delete that line and substitute "month beginning after publication.".

SB379-SA2,2,12 15. Page 13, line 15: delete lines 15 and 16.
