SB291-SA2,2,104 (am) To be designated as a severely distressed tax incremental district under
5par. (a), a district must meet all of the conditions under par. (a) and its value
6increment in any year must have declined at least 25 percent from the district's
7highest value increment determined by the department of revenue over the course
8of the district's life. The joint review board may request that the department of
9revenue certify that a district meets the decline in value increment percentage
10described in this paragraph.".

12incremental district under this subsection exceed the amount needed to meet the
13distressed, or severely distressed, district's annual expenditures identified in its
14existing project plan, the excess amount shall be used to retire any outstanding debt
15obligations of the district or to establish a reserve fund that may be used only to retire
16outstanding debt obligations of the distressed, or severely distressed, district.".
