AB8-ASA1-AA12,1,11 At the locations indicated, amend the substitute amendment as follows:
AB8-ASA1-AA12,1,3 21. Page 9, line 6: delete the material beginning with that line and ending with
3page 10, line 6, and substitute:
AB8-ASA1-AA12,1,4 4" Section 4d. 227.135 (2) of the statutes is amended to read:
AB8-ASA1-AA12,2,95 227.135 (2) Until An agency that has prepared a statement of the scope of the
6proposed rule shall present the statement to the governor and to
the individual or
7body with policy-making powers over the subject matter of a the proposed rule
8approves a statement of the scope of the proposed rule, a state employee or official
9may not perform any activity in connection with drafting the proposed rule except
10for an activity necessary to prepare the statement
for approval. The governor and
11the
individual or body with policy-making powers may not approve a the statement
12until at least 10 days after publication of the statement in the register as required

1under sub. (3). If the governor and the individual or body with policy-making powers
2does do not disapprove the statement within 30 days after the statement is presented
3to the governor and to the individual or body, or by the 11th day after publication of
4the statement in the register, whichever is later, the statement is considered to be
5approved. No state employee or official may perform any activity in connection with
6the drafting of a proposed rule, except for an activity necessary to prepare the
7statement of the scope of the proposed rule, and no agency may send such a statement
8to the legislative reference bureau for publication under sub. (3), until the statement
9is approved as provided in this subsection.
AB8-ASA1-AA12, s. 5d 10Section 5d. 227.135 (3) of the statutes is amended to read:
AB8-ASA1-AA12,2,1511 227.135 (3) The agency shall send the If a statement of the scope of a proposed
12rule is approved as provided in sub. (2), the agency shall send the statement to the
13legislative reference bureau for publication in the register. On the same day that the
14agency sends the statement to the legislative reference bureau, the agency shall send
15a copy of the statement to the secretary of administration.".
