SENATE AMENDMENT 14, TO SENATE BILL 1

January 18, 2011 - Offered by Senators Erpenbach, Risser and Miller.

SB1-SA14,1,1 At the locations indicated, amend the bill as follows:

SB1-SA14,1,5 1. Page 10, line 20: after "or (3m)" insert "and except that a person who participates in the review or evaluation shall disclose an incident or occurrent report to a court of record with regard to any criminal matter, in accordance with chs. 885 to 895 and 995 and after issuance of a subpoena".

SB1-SA14,1,7 2. Page 11, line 5: delete the material beginning with "except for" and ending with "providers," on line 7.

SB1-SA14,1,9 3. Page 11, line 16: delete the material beginning with "civil or" and ending with "criminal" on line 17 and substitute "civil".

SB1-SA14,1,10 4. Page 13, line 6: delete "or criminal".

SB1-SA14,2,2 5. Page 13, line 7: after "health care provider." insert "A record described under sub. (2) disclosed either under sub. (3) or (3m) or in violation of this section remains confidential and may not be used in any criminal action against the health care provider or any other health care provider.".

SB1-SA14,2,3 6. Page 27, line 10: delete "or criminal".
