SENATE AMENDMENT 21,
TO SENATE BILL 1

SB1-SA21,1,11 At the locations indicated, amend the bill as follows:
SB1-SA21,1,2 21. Page 2, line 3: delete "and punitive" and substitute "punitive".
SB1-SA21,1,3 32. Page 2, line 4: after "awards" insert "; and making an appropriation".
SB1-SA21,1,4 43. Page 9, line 1: before that line insert:
SB1-SA21,1,6 5" Section 1e. 20.005 (3) (schedule) of the statutes: at the appropriate place,
6insert the following amounts for the purposes indicated: - See PDF for table PDF
SB1-SA21, s. 1m 7Section 1m. 20.625 (1) (cm) of the statutes is created to read:

120.625 (1) (cm) Lay and expert witness hearing expenses. Biennially, the
2amounts in the schedule to cover actual, additional, and necessary expenses incurred
3by a circuit court branch to comply with ss. 907.01 and 907.02.".

SB1-SA21,2,7 7(1) Circuit court branch requests for appropriation increases.
SB1-SA21,2,188 (a) A circuit court branch may submit a written request to the director of state
9courts specifying the actual, additional, and necessary expenses incurred by the
10branch to comply with sections 907.01 and 907.02 of the statutes, as affected by this
11act, including, if applicable, additional workload generated by expert witness
12hearings held pursuant to section 907.02 of the statutes, as affected by this act. Upon
13receipt of a request from a circuit court branch under this paragraph, the director of
14state courts shall submit to the joint committee on finance a request to supplement
15the appropriation account under section 20.625 (1) (cm) of the statutes, as created
16by this act, for the purposes of covering the actual, additional, and necessary
17expenses incurred by the branch to comply with sections 907.01 and 907.02 of the
18statutes, as affected by this act.
SB1-SA21,3,8 19(b) If the cochairpersons of the joint committee on finance do not notify the
20director of state courts within 14 working days after receiving the request under
21paragraph (a) that the cochairpersons have scheduled a meeting for the purpose of
22reviewing the request, the appropriation account under section 20.625 (1) (cm) of the
23statutes shall be supplemented from the appropriation account under section 20.865
24(4) (a) of the statutes, as provided in the request. If, within 14 working days after

1receiving the request, the cochairpersons notify the director of state courts that the
2cochairpersons have scheduled a meeting for the purpose of reviewing the request,
3the appropriation account under section 20.625 (1) (cm) of the statutes may be
4supplemented from the appropriation account under section 20.865 (4) (a) of the
5statutes only as approved by the committee. Notwithstanding section 13.101 (3) of
6the statutes, the committee is not required to find that an emergency exists prior to
7supplementing the appropriation account under section 20.625 (1) (cm) of the
8statutes.
SB1-SA21, s. 44r 9Section 44r. Fiscal changes.
SB1-SA21,3,17 10(1) Lay and expert witness hearing expenses. In the schedule under section
1120.005 (3) of the statutes for the appropriation to the joint committee on finance
12under section 20.865 (4) (a) of the statutes, as affected by the acts of 2011, the dollar
13amount is increased by $1,000,000 for the first fiscal year of the fiscal biennium in
14which this subsection takes effect for the purpose of covering the actual, additional
15and necessary expenses incurred by circuit court branches to comply with sections
16907.01 and 907.02 of the statutes, as affected by this act, in response to requests
17received under Section 44g of this act.".
SB1-SA21,3,18 186. Page 31, line 3: delete lines 3 to 5 and substitute:
SB1-SA21,3,20 19" Section 46m. Effective dates. This act takes effect on the first day of the 2nd
20month beginning after publication, except as follows:
SB1-SA21,4,2 21(1) The treatment of section 20.625 (1) (cm) of the statutes and Sections 44g
22and 44r of this act take effect on the first day of the 2nd month beginning after

1publication, or on the 2nd day after publication of the 2011-13 biennial budget act,
2whichever is later.".
