TO 2011 ASSEMBLY BILL 215

AB215-ASA1,1,4 1An Act to amend 48.65 (2) (b); and to create 48.65 (2) (bm) of the statutes;
2relating to: requiring a public school or a private school that provides child
3care for children under three years of age to be licensed to operate a child care
4center.
Analysis by the Legislative Reference Bureau
Under current law, no person may for compensation provide care and
supervision for four or more children under seven years of age for less than 24 hours
a day unless that person obtains a license to operate a child care center from the
Department of Children and Families. Certain persons, however, including public,
parochial, or tribal schools, are exempt from this requirement. This substitute
amendment requires a public school or a private school that provides such care and
supervision for children under three years of age to obtain a license to operate a child
care center.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB215-ASA1, s. 1 5Section 1. 48.65 (2) (b) of the statutes is amended to read:

148.65 (2) (b) A public or parochial school or a tribal school.
AB215-ASA1, s. 2 2Section 2. 48.65 (2) (bm) of the statutes is created to read:
AB215-ASA1,2,43 48.65 (2) (bm) A public school or a private school, unless the public school or
4private school provides care and supervision for children under 3 years of age.
AB215-ASA1, s. 3 5Section 3. Initial applicability.
AB215-ASA1,2,96 (1) Child care licensing of public and private schools. Except as provided in
7subsection (2), this act first applies to a public school or private school that provides
8care and supervision for a child under 3 years of age on the effective date of this
9subsection.
AB215-ASA1,2,1610 (2) Child care licensing of public and accredited private schools; grace
11period.
This act first applies to a public school, or to a private school that is accredited
12by an accrediting agency specified in section 118.60 (2) (a) 7. of the statutes, that at
13any time during the 24 months prior to the effective date of this subsection provided
14care and supervision for a child under 3 years of age without a license under section
1548.65 (1) of the statutes on the first day of the 36th month beginning after effective
16date of this subsection.
