AB94-AA12,1,11 At the locations indicated, amend the bill as follows:
AB94-AA12,1,2 21. Page 5, line 17: after that line insert:
AB94-AA12,1,3 3" Section 6g. 119.23 (7) (h) of the statutes is created to read:
AB94-AA12,1,54 119.23 (7) (h) Annually, by August 1, the state superintendent shall, with the
5assistance of the department of justice, do all of the following:
AB94-AA12,1,76 1. Conduct a criminal history records search on each teacher and administrator
7employed by and owner of a participating private school.
AB94-AA12,1,98 2. Determine whether any teacher and administrator employed by or owner of
9a participating private school is required to register as a sex offender under s. 301.45.
AB94-AA12, s. 6r 10Section 6r. 119.23 (7) (i) of the statutes is created to read:
AB94-AA12,2,311 119.23 (7) (i) 1. a. Notwithstanding subch. II of ch. 111, except as provided in
12subd. 1. b., a private school participating in the program under this section may not
13employ a person convicted of any Class A, B, C, D, E, F, G, or H felony under ch. 940

1or 948, except ss. 940.08 and 940.205, for 6 years following the date of conviction, and
2may employ such a person after 6 years only if the person establishes by clear and
3convincing evidence that he or she is entitled to be employed.
AB94-AA12,2,84 b. A private school participating in the program under this section may employ
5a person convicted of a crime enumerated in subd. 1. a. prior to the expiration of the
66-year period following the conviction, if the private school receives from the court
7in which the conviction occurred a certificate stating that the conviction has been
8reversed, set aside, or vacated.
AB94-AA12,2,109 2. A private school participating in the program under this section may not
10employ a person required to register as a sex offender under s. 301.45.".
