SENATE AMENDMENT 4, TO SENATE SUBSTITUTE AMENDMENT 1, TO 2011 SENATE BILL 20

SB20-SSA1-SA4,1,1 At the locations indicated, amend the substitute amendment as follows:

SB20-SSA1-SA4,1,2 1. Page 2, line 1: before that line insert:

SB20-SSA1-SA4,1,3 " Section 1e. 119.16 (1m) of the statutes is amended to read:

SB20-SSA1-SA4,1,7 119.16 (1m) Management of school district. The Except as provided in s. 119.60 (2m) (a), (c) 1., and (d) 1., the board shall have the possession, care, control, and management of the schools, facilities, operations, property, and affairs of the school district.

SB20-SSA1-SA4, s. 1m Section 1m. 119.16 (3) (a) of the statutes is amended to read:

SB20-SSA1-SA4,2,2 119.16 (3) (a) The Except as provided in s, 119.60 (2m) (a), (c) 1., and (d) 1., the board shall construct, purchase, lease, improve, or enlarge buildings and purchase furniture and sites for the public schools, shall purchase, install , and maintain heating systems in public schools and may contract for carrying out any of these purposes.".

SB20-SSA1-SA4,2,9 3. Page 4, line 15: after "or lease." insert "If a resolution is adopted as provided under this paragraph, the city shall assume financial responsibility for the maintenance, care, and upkeep of the property identified in the resolution, including the maintenance of heating systems, fixtures, and equipment within the property, until the property has been sold or leased or until the common council adopts a resolution withdrawing and withholding the property from sale or lease.".

SB20-SSA1-SA4,2,18 7. Page 4, line 23: delete the material beginning with that line and ending with page 5, line 2, and substitute:

SB20-SSA1-SA4,2,20 "(d) If any real property within the city which is used for school purposes is leased as provided in this subsection, all of the following apply:

SB20-SSA1-SA4,2,23 1. The lessee of the property shall assume full financial responsibility for the maintenance, care, and upkeep of the property, including the maintenance of heating systems, fixtures, and equipment within the property, for the duration of the lease.

SB20-SSA1-SA4,3,2 2. The net proceeds of the lease shall be deposited in the school operations fund under s. 119.46.".
