SB306-AA9,1,11 At the locations indicated, amend the bill as follows:
SB306-AA9,1,5 21. Page 6, line 18: after "woman" insert "or if the person is licensed under ch.
3441 or 448 and was acting within the scope of the practice of professional or practical
4nursing or of medicine and surgery and the person's actions were accepted medical
5practice, as determined by the board of nursing or the medical examining board
".

SB306-AA9,1,11 7"(4m) Affirmative defense. No person is liable under sub. (3) or (4) if the
8person is licensed under ch. 441 or 448 and was acting within scope of the practice
9of professional or practical nursing or of medicine and surgery and the person's
10actions were accepted medical practice, as determined by the board of nursing or the
11medical examining board.".

1939.425 Medical practice. It is a defense to a crime or a law imposing a
2forfeiture that a person who is licensed under ch. 441 or 448 was acting within the
3scope of the practice of professional or practical nursing or of medicine and surgery,
4and that his or her actions were accepted medical practice, as determined by the
5board of nursing or the medical examining board, at the time the act occurred.".
